Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
DETAILED ACTION
This action is in response to communications filed on 8/12/2025. Claims 1-10 have been preliminarily cancelled, claims 11-20 have been newly added. Accordingly, claims 11-20 are pending.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 11- 20 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Bohrmann (US 2022/0219705 A1).
Bohrmann discloses:
11: A method comprising:
determining, by a vehicle, a route lying ahead of the vehicle (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 58; vehicle movements for a route ahead);
predicting a next transverse acceleration acting on an occupant of the vehicle (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 58; vehicle movements for a route ahead); and
pivoting a chassis or a vehicle seat of the vehicle occupied by the occupant, in a direction of the predicted next transverse acceleration before onset of the predicted next transverse acceleration so that the occupant of the vehicle is prompted to perform a countermovement of an upper body or a head of the occupant of the vehicle so as to reduce or avoid kinetosis of the occupant of the vehicle (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 58; method for predicting & reducing Kinetosis-induced of an occupant of a vehicle).
12: wherein the pivoting of the chassis or the vehicle seat occupied by the occupant in the direction of the predicted next lateral acceleration is performed a few hundred milliseconds before the onset of the predicted next acceleration (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 51- 58; driving dynamics, pitch & roll stabilization and adjusting chassis).
13: further comprising: pivoting the chassis or the vehicle seat occupied by the occupant against the direction of the predicted next lateral acceleration to support a countermovement of the occupant (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 51- 58).
14: wherein the pivoting the chassis or the vehicle seat occupied by the occupant against the direction of the predicted next lateral acceleration is performed synchronously with the countermovement of the occupant (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 51- 58).
15: further comprising: determining the countermovement of the occupant of the vehicle (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 51- 58).
16: further comprising: outputting acoustic, visual, or tactile information to the occupant of the vehicle as a further measure to reduce or prevent kinetosis (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 51- 60).
17: wherein an intensity of the outputted acoustic, visual, or tactile information is predetermined depending on a magnitude of the predicted next lateral acceleration (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 51- 60).
18: further comprising: determining presence of at least one predetermined kinetosis criterion, wherein the pivoting a chassis or a vehicle seat of the vehicle occupied by the occupant is only performed when the presence of at least one predetermined kinetosis criterion is determined (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 51- 60).
19: wherein the pivoting a chassis or a vehicle seat of the vehicle occupied by the occupant is only performed when the predicted next lateral acceleration exceeds a predetermined lateral acceleration threshold and the presence of at least one further specified kinetosis criterion is determined.
20: wherein the predetermined kinetosis criterion is one of:- the occupant of the vehicle exhibits a susceptibility to the kinetosis,- a current driving duration the vehicle exceeds a predetermined driving duration threshold, U.S. Application No. NEW Page 7 - the occupant of the vehicle is performing a secondary activity independent of operation of the vehicle, - a viewing direction of the occupant of the vehicle is directed downwards or away from windows of the vehicle or directed towards an object related to the secondary activity, - an interior temperature of the vehicle exceeds a predetermined interior temperature threshold, or - a discomfort of the occupant is determined (see Bohrmann at least fig. 1 and Abstract and ¶10, 41, 51- 60).
