The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Objections
Claims 16-18 are objected to because of the following informalities:
Claims 16-18, uses the term “such as” in line 2, it is not clear if applicant intends that phrases following “such as” to be optional or they should be interpreted as a definite statement. Examiner suggests removing the term “such as” to clearly define the scope of the claim.
Appropriate correction is required.
Specification
The amendment filed 11/15/2025 is objected to under 35 U.S.C. 132(a) because it introduces new matter into the disclosure. 35 U.S.C. 132(a) states that no amendment shall introduce new matter into the disclosure of the invention. The added material which is not supported by the original disclosure is as follows:
A method performed by a reader device may comprise transmitting periodic synchronization signals to at least one device configured to ignore information transmitted during reception gap periods and transmitting a synchronization signal of the periodic synchronization signals and indicating by way of the synchronization signal that broadcast information follows another synchronization signal, in time. The reader device may process the broadcast information before transmitting another subsequent synchronization signal. The method may further comprise receiving a preamble, a first Physical Device-to-Reader Channel (PDRCH) transmission and a first midamble of a first length and receiving a second PDRCH transmission and second midamble of a second length, wherein the second length is longer than the first length. The first midamble may be received from a first power capability device and the second midamble is received from a second power capability device different from the first power capability device. The first PDRCH and the second PDRCH may be transmitted using different types of phase shift keying modulation.
Applicant is required to cancel the new matter in the reply to this Office Action.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 12-22 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
As of claim 12, limitations “A method performed by a reader device, the method comprising: transmitting periodic synchronization signals to at least one device configured to ignore information transmitted during reception gap periods; transmitting a synchronization signal of the periodic synchronization signals and indicating by way of the synchronization signal that broadcast information follows another synchronization signal, in time; transmitting the broadcast information after transmitting the another synchronization signal; receiving a preamble, a first Physical Device-to-Reader Channel (PDRCH) transmission and a first midamble of a first length; receiving a second PDRCH transmission and second midamble of a second length, wherein the second length is longer than the first length; wherein the first midamble is received from a first power capability device and the second midamble is received from a second power capability device different from the first power capability device; wherein the first PDRCH and the second PDRCH are transmitted using different types of phase shift keying modulation” does not have support in the original specification filed on 04/09/2025.
Claims 13-22 directly or indirectly depend on claim 12 and inherent the same issue.
