Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim(s) 1-3 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by US 2022/0387169 (Ellis). 1. An accommodating intraocular lens (IOL)(IOL 10) comprising a shape-changing optic (optic 12) configured for placement in or adjacent to a lens capsule (P0013 and P0051), the IOL having an optical axis (optical axis CA) extending in an anterior-posterior direction (FIG. 2; P0038), an equator (equator E) extending in a plane substantially perpendicular to the optical axis (FIG. 2; P0038), an accommodated state (P0035), a dis-accommodated state (P0035), and states therebetween (P0035), the IOL comprising: an elastic anterior face (anterior face 14) located anterior to the equator, having an anterior surface (anterior surface 16), a posterior surface (posterior surface 18), and a periphery (periphery 20)(FIG. 1-2; P0038); a posterior refractive power adjustment optic (face 22 which is power adjustment at P0038) located posterior to the equator (FIG. 1-2; P0038), having an anterior surface (anterior surface 24), a posterior surface (posterior surface 26), and a periphery (periphery 28), the posterior refractive power adjustment optic comprising silicone (P0053) and allowing modification of the refractive power of the IOL when exposed to a light source (P0042 and P0054); an elastic side wall (side wall 30) extending across the equator and extending from the anterior face to the posterior optic (FIG. 1-2; P0038); a chamber (chamber 32) located between the anterior face and the posterior optic and containing a fluid (FIG. 1-2; P0038 and P0042), wherein the anterior face is more resistant to deformational change than the fluid (P0041 and P0043); a plurality of haptics (haptics 34) each having a medial portion and a lateral portion extending from the periphery of the anterior face (FIG. 3-4; P0038 and P0043); and a coating (“coating” at P0042) disposed between the posterior refractive power adjustment optic and the chamber (P0042), the coating comprising a material (“parylene” at P0042) that prevents entry of the fluid in the chamber into the posterior refractive power adjustment optic (P0042). 2. The coating is disposed on the anterior surface of the posterior refractive power adjustment optic (see chamber 32 having “an internal layer or coating” of parylene at P0042). 3. The coating comprises parylene (P0042).
