Office Action

§102
DETAILED ACTION This office action is a response to an application filed 04/21/2025, wherein claims 1-20 are pending and ready for an examination. Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority This application discloses and claims only subject matter disclosed in prior Application No. 17/104,492 and 18514,244, filed 11/25/2020 and 11/20/2023, and names the inventor or at least one joint inventor named in the prior application. Accordingly, this application may constitute a continuation or divisional. Should applicant desire to claim the benefit of the filing date of the prior application, attention is directed to 35 U.S.C. 120, 37 CFR 1.78, and MPEP § 211 et seq. The presentation of a benefit claim may result in an additional fee under 37 CFR 1.17(w)(1) or (2) being required, if the earliest filing date for which benefit is claimed under 35 U.S.C. 120, 121, 365(c), or 386(c) and 1.78(d) in the application is more than six years before the actual filing date of the application. Information Disclosure Statement The information disclosure statement (IDS) submitted on 04/21/2025 was filed before the mailing date of the non-final action on 07/15/2026. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b). The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13. The USPTO Internet website contains terminal disclaimer forms which may be used. Please visit www.uspto.gov/patent/patents-forms. The actual filing date of the application in which the form is filed determines what form (e.g., PTO/SB/25, PTO/SB/26, PTO/AIA /25, or PTO/AIA /26) should be used. A web-based eTerminal Disclaimer may be filled out completely online using web-screens. An eTerminal Disclaimer that meets all requirements is auto-processed and approved immediately upon submission. For more information about eTerminal Disclaimers, refer to www.uspto.gov/patents/apply/applying-online/eterminal-disclaimer. Claims 1, 3 and 5-20 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-8, 10-13 and 1-20 of U.S. Patent No. US11831518B2 and US12289217B2. See the claim correspondence table below. Although the claims at issue are not identical, they are not patentably distinct from each other because the present claims differ from the patented claims only by the omission of specific limitations. The only difference is that the present claims are broader only in that they omit specific limitations recited in the patent. It would have been obvious to one of a person ordinary skill in the art, before the effective filing date of the invention, to broaden the claims to obtain broader patent protection. With respect to claim 9, Nickolov discloses the method of claim 1, further comprising, providing, on the dashboard interface, environment-wise and vendor-wise data for the one or more datacenter components (Nickolov, ¶0414, teaches Global access to appliance and/or application catalogs which, for example, may be consistent across all (or selected) grids of the Cloudware network, and may be implemented using a centralized repository, ¶0691, teaches the user dashboard page may be accessible to various entities or Cloudware customers such as, for example: data center operators, end users, publishers (e.g., publishers of applications, appliances), etc., ¶1035, teaches independent data center operators to build grids, register them with the service and start receiving customer workloads. It allows independent software vendors to build appliances and applications, publish them on the service and start receiving revenue and support requests as their appliances and applications are used, ¶2066, teaches the boot information needed to start the component in the virtual environment for which it may be designed). With respect to claims 10 and 19, Nickolov discloses the method of claim 1, wherein the one or more datacenter components include a storage capacity for the datacenter; and wherein the method further comprises: initiate an API call to a proprietary application associated with the storage capacity component to request storage capacity information (Nickolov, ¶1793, teaches the Cloudware network may be configured or designed to automatically detect a need for additional capacity at one or more data centers, and may automatically respond by taking appropriate action to power-up additional servers at one or more data centers); and generating a storage capacity interface, upon being selected from the dashboard interface, that displays aggregated storage capacity information of the datacenter (Nickolov, ¶0712, teaches a secondary GUI (e.g., Application Settings GUI 920) is displayed to the user which enables the user to access and/or modify various settings relating to the selected application instance such as, for example, one or more of the following (or combinations thereof): Advanced resource settings (e.g., minimum/maximum resource ranges, defaults, disk storage capacity, bandwidth, etc.), Other details/settings associated with the selected application (e.g., 908) . With respect to claims 11, Nickolov discloses the method of claim 1, wherein the one or more datacenter components includes a network port capacity for the datacenter (Nickolov, ¶0221, teaches Virtual network interfaces are used to abstract the structure of the network interconnect inside the distributed application. A pair of virtual network interfaces, such as VNI1 and VNI3, is used to create a “virtual wire” between virtual network adapters vNIC1 and vNIC3, which belong to virtual machines VM1 and VM2, respectively. The virtual wire operates in a manner equivalent to a cross-over cable that connects two physical network interface cards directly: it transfers packets from one of the cards to the other and vice-versa, ¶1793, teaches the Cloudware network may be configured or designed to automatically detect a need for additional capacity at one or more data centers, and may automatically respond by taking appropriate action to power-up additional servers at one or more data centers); and wherein the method further comprises: generating a network port capacity interface, upon being selected from the dashboard interface, that displays switch port capacity by one or more switches of the datacenter (Nickolov, ¶0221, teaches A pair of virtual network interfaces, such as VNI1 and VNI3, is used to create a “virtual wire” between virtual network adapters vNIC1 and vNIC3, which belong to virtual machines VM1 and VM2, respectively. The virtual wire operates in a manner equivalent to a cross-over cable that connects two physical network interface cards directly: it transfers (i.e. switch) packets from one of the cards to the other and vice-versa, ¶1793, teaches the Cloudware network may be configured or designed to automatically detect a need for additional capacity at one or more data centers, and may automatically respond by taking appropriate action to power-up additional servers at one or more data centers, ¶1851, teaches whenever a change of state may be detected, the global user dashboard may preferably send notifications). With respect to claims 13 and 18, Nickolov discloses the non-transitory computer storage media of claim 12, further comprising instructions that cause the processor to: identify the API call that is associated with the proprietary application corresponding to the selected datacenter component from an available set of APIs (¶0095, teaches one or more of the data centers may be operable to host a variety of different types of applications (i.e. proprietary applications )and/or other software, ¶0369, teaches , the API(s) gateway provides programmatic access to Cloudware services, ¶0555, teaches information may include a current, real-time number of instances of the virtual appliance which are currently instantiated at all (or selected) data centers of the Cloudware network, ¶1002, teaches API which may provide full access to all or selected capabilities available on a shell, ¶1564, teaches applications may be provided for people who would like to offer proprietary software on AppLogic™; proprietary software may include, for example, proprietary packaging of open-source software). Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
