Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-4 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Christopher et al. (US 10,753,696), hereinafter (“Christopher”), and provided by applicant.
Re claims 1 and 4, Christopher (Fig 6) discloses a dust cover (64) for a firearm, the dust cover defining: a body configured to rotate about a hinge pivot (66), the body defining an internal dust cover surface and an external dust cover surface, wherein the external dust cover surface is configured to align with and directly or indirectly actuate a button (24; see also c. 4, l. 25-36) of the firearm
Re claims 2 and 3, Christopher discloses the dust cover of claim 1, wherein the body of the dust cover is configured to rotate about the hinge pivot between an open position and a closed position, wherein the dust cover comprises a biasing mechanism (Fig 6, 32) to bias the dust cover to the open position.
Allowable Subject Matter
Claims 5-7 objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claims 8-20 allowed.
