DETAILED ACTION 1. The Office Action is in response to Application 191916182 filed on 04/28/2025. Claims 1-3 are pending. Notice of Pre-AIA or AIA Status 2. The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Double Patenting 3. The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory obviousness-type double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. For claim 1, it recites limitations of “the video signal” in “a memory for storing the video signal”; However, there is no antecedence basis for this limitation; it recites limitations of “derive an intra prediction mode of a current block” first, then it recites that: “based on the current block being a non-square block, a first intra prediction mode is used as the intra prediction mode of the current block, instead of a second intra prediction mode covering a specific angle range in a plurality of intra prediction modes, and wherein the second intra prediction mode is determined based on a ratio of the width and height of the current block”; However, it is not clear what is the relationship between the “intra prediction mode of a current block derived” and “a first intra prediction mode, a second intra prediction mode”, is the intra prediction mode of a current block derived is the first intra prediction mode or the second intra prediction mode or other kinds of mode? In addition to that, it is not clear how the first intra mode is determined; Does it means any kind of intra prediction mode instead of the second mode (which is determined based on a ratio of the width and height of the current block) can be used? Thus the scope of the claim is unclear. 17. Claim 2 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention for the similar reason as for claim 1. 18. Claim 3 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, or for pre-AIA the applicant regards as the invention. For claim 3, it recites limitations of “the bitstream for the image” in “a processor configured to obtain the bitstream for the image”; “the data” in “and a transmitter configured to transmit the data comprising the bitstream” However, there are no antecedence basis for these limitations; it recites limitations of “deriving an intra prediction mode of a current block” first, then it recites that: “based on the current block being a non-square block, a first intra prediction mode is used as the intra prediction mode of the current block, instead of a second intra prediction mode covering a specific angle range in a plurality of intra prediction modes, and wherein the second intra prediction mode is determined based on a ratio of the width and height of the current block”; However, it is not clear what is the relationship between the “intra prediction mode of a current block derived” and “a first intra prediction mode, a second intra prediction mode”, is the intra prediction mode of a current block derived is the first intra prediction mode or the second intra prediction mode or other kinds of mode? In addition to that, it is not clear how the first intra mode is determined; Does it means any kind of intra prediction mode instead of the second mode (which is determined based on a ratio of the width and height of the current block) can be used?
