Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 11-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 11 recites the limitation "PCB" in line 6. However, it is unclear what, specifically, the scope of this represents. It appears to be an acronym, but it is not further defined in the claims or the specification. Clarification is required.
The claims are replete with insufficient antecedent basis issues; it is requested to review the claims and correct every issue. Some of the found issues include, but not limited to:
Claim 11 recites the limitation "the inner lever" in line 15. There is insufficient antecedent basis for this limitation in the claim.
Claim 11 recites the limitation "the large locking tongue sliding hole" in line 16. There is insufficient antecedent basis for this limitation in the claim.
Claim 11 recites the limitation "the outer lever" in 17. There is insufficient antecedent basis for this limitation in the claim.
Claim 11 recites the limitation "the manual unlocking lever" in lines 21-22. There is insufficient antecedent basis for this limitation in the claim.
Claim 11 recites the limitation "the first inner unlocking lever" in line 23. There is insufficient antecedent basis for this limitation in the claim.
Claim 11 recites the limitation "the second inner unlocking lever" in line 26. There is insufficient antecedent basis for this limitation in the claim.
Claim 11 recites the limitation "the protruded braking head" in lines 33-34. There is insufficient antecedent basis for this limitation in the claim.
Claim 11 recites the limitation "the internal tooth grooves" in line 35. There is insufficient antecedent basis for this limitation in the claim.
Claim 11 recites the limitation "the small locking tongue sliding hole" in lines 44-45. There is insufficient antecedent basis for this limitation in the claim.
Allowable Subject Matter
Claims 11-20 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is a statement of reasons for the indication of allowable subject matter: The claims are allowable over the prior art of record because the teachings of the references taken as a whole do not teach or render obvious the combination set forth, including that of a caravan lock with anti-motor stalling linkage structure having a toothed clutch mechanism comprises a rotary sliding tooth disc and an inner tooth disc, wherein the toothed clutch mechanism is installed within the housing through the inner tooth disc, wherein the drive shaft of the rotary shaft motor is attached to the center hole of the inner tooth disc which is disposed within the rotary sliding tooth disc, wherein the surface of the inner tooth disc is designed with evenly spaced holes that allow for elastic deformation, wherein the outer diameter of the inner tooth disc is provided with at least one side of a protruded braking head, wherein the outer diameter of the internal gear disc features a braking head wedged into a internal tooth grooves that are evenly spaced along the inner diameter of the rotary sliding tooth disc, or alternatively, the braking head of the inner tooth disc is wedged along the inner diameter of the rotary sliding tooth disc.
