The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Information Disclosure Statement
The information disclosure statement filed 4/29/25 fails to comply with 37 CFR 1.98(a)(2), which requires a legible copy of each cited foreign patent document; each non-patent literature publication or that portion which caused it to be listed; and all other information or that portion which caused it to be listed. It has been placed in the application file, but the information referred to therein has not been considered.
Each publication must be identified by publisher, author (if any), title, relevant pages of the publication, and date and place of publication. The date of publication supplied must include at least the month and year of publication, except that the year of publication (without the month) will be accepted if the applicant points out in the information disclosure statement that the year of publication is sufficiently earlier than the effective U.S. filing date and any foreign priority date so that the particular month of publication is not in issue. The place of publication refers to the name of the journal, magazine, or other publication in which the informa-tion being submitted was published.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-3, 5, 6, 9-12, 14, 15, 17-20 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Jawdat (US 4,461,203). Jawdat discloses a firearm comprising: a chassis (i.e. frame, Fig. 14); a barrel (12) connected to the chassis and having a breech end defining a chamber (Fig. 14); a slide (11) operable to reciprocate with respect to the chassis between a forward battery position and a rearward recoil position; a reciprocating block (1) connected to the chassis and operable to reciprocate with respect to the slide between a block rear position (Fig. 15) in which a first limit surface (16) of the slide abuts the block (via 4 @ 8 and 7), and a block forward position (Fig. 14) in which the block is spaced apart from the first limit surface of the slide; the reciprocating block operable to reciprocate with respect to the barrel between a chamber open position (Fig. 15) in which a face portion of the block is spaced apart from the breech end of the barrel and a chamber closed position (Fig. 14) in which the face portion of the block is proximate the breech end of the barrel; a locking element (4) selectively engaging at least the slide and the block and operable to prevent rearward movement of the block when the slide is in the battery position (Fig. 14), and to enable rearward movement of the block when the slide has moved rearward with respect to the block by a limited distance to an intermediate position (there are unlimited number of intermediate positions) forward of the recoil position.
2. The firearm of claim1 wherein the locking element is operable to engage the block to the slide rearward of the intermediate position. (Fig. 15)
3. The firearm of claim 1 wherein the slide defines a bore having a first diameter portion configured to engage the locking element over a first range of motion of the slide, and a different second diameter portion (the smaller diameter at 16) configured to engage the locking element over a second range of motion of the slide.
5. The firearm of claim 1 wherein the block includes a locking element holder portion defining a receptacle (the area between 7 and the front of block) receiving the locking element.
6. The firearm of claim 5 wherein the locking element holder portion is interposed between a portion of the slide and the barrel (Fig. 14 and 15).
9. The firearm of claim 1 wherein the slide defines a bore encompassing at least a portion of the barrel (Figs. 14 and 15), and defining a slide recess (@18) in the bore.
10. The firearm of claim 9 wherein the barrel has an exterior surface defining a barrel recess, and wherein the locking element is constrained to reside in at least one of the slide recess and the barrel recess (Fig. 14).
11. The firearm of claim 1 wherein the block includes a breech face. (Fig. 14)
12. The firearm of claim 1 wherein the block includes a firing pin (col. 2, line 45) operable to reciprocate with respect to the block.
14. The firearm of claim 1 wherein the slide has a second limit surface (6’; Fig. 14) contacting the block when in the block forward position.
15. The firearm of claim 1 wherein slide defines a bore, and the block includes a sleeve portion (4) received in the bore, and a portion of the barrel is received in the sleeve (Fig. 14).
17. The firearm of claim 1 wherein the block is an elongated body extending from proximate to a forward portion of the slide to proximate to a rear portion of the slide. (Figs. 14 and 15)
18. A firearm comprising: a chassis; a slide connected to the chassis and having a first recessed area; a barrel fixed to the chassis having a second recessed area; a reciprocating bolt (1) containing at least one locking element; and the locking element operable to engage with the second recessed area when the slide is in a first condition, and engageable with the first recessed area when the slide is in a second condition. (see remarks above with regards to claim 1)
19. A firearm comprising: a chassis; a barrel connected to the chassis; a slide connected to the chassis and operable to reciprocate with respect to the chassis; and a block connected to the chassis and operable to reciprocate with respect to the chassis and to the slide. (see remarks above with regards to claim 1)
20. The firearm of claim 19 wherein moving locking elements (4) selectively engage barrel, slide, and block (Fig. 14).
Allowable Subject Matter
Claims 4, 7, 8, 13 and 16 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
