Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1-4 are rejected under 35 U.S.C. 102 (a) (1) and (a) (2) as being anticipated by US Patent 2782955 issued to Gordon (Here forth “Gordon”).
Regarding claim 1, Gordon discloses a transport unit for a protective enclosure for an antenna, wherein said transport unit is configured to securely and removably receive said enclosure, wherein said transport unit is transportable (Fig 1 of Gordon, the lug box is capable of protecting multiple enclosures for items and therefore can protect an enclosure for an antenna; Column 1 lines 21-27 of Gordon), and wherein exterior walls of said transport unit are rigid (Column 1 lines 35-39 of Gordon), to thereby protect said enclosure during transport (Column 1 lines 16-18 of Gordon).
Regarding claim 2, Gordon further discloses wherein said transport unit is collapsible (Column 1, lines 36-37; Fig 2 of Gordon).
Regarding claim 3, Gordon further discloses wherein said transport unit is nestable with other transport units (Column 1 lines 36-28 of Gordon).
Regarding claim 4, Gordon further discloses wherein an interior configuration of said transport unit is configurable to securely and removably receive a plurality of protective enclosures (Fig 1 of Gordon, the lug box is capable of protecting multiple enclosures for items and therefore can protect multiple enclosures for an antennas depending on the size; Column 1 lines 21-27 of Gordon).
