Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claims 1-2 are rejected under 35 U.S.C. 103 as being unpatentable over Ryu (KR 102462750) in view of Richardson (US 2026/0081355).
Regarding claim 1, Ryu discloses in Figure 2, a hybrid material-based submarine radome comprising:
a cap (10) having an open interior and having an insert provided on an inner perimeter thereof;
a bracket (20); and
a body (30),
wherein the bracket (20) includes a threaded part (21) corresponding with the insert (11),
the bracket (20) is securable to the cap in a manner of a screw, and the bracket (20) is formed from a metallic material (see par. 0007).
Ryu is silent on the cap comprising a cap hemisphere and a cap cylinder. However, such differences are not patentable merit. A cap comprising a cap hemisphere and a cap cylinder to protect antenna from environment is well known in the art. One of such examples is the teaching of Richardson, Figure 2, the cap comprising a cap hemisphere (102) having an open interior; a cap cylinder (104) having an open interior and an insert provided on an inner perimeter thereof. It would have been obvious to one having ordinary skill in the art before the effective filing date of claimed invention
Regarding claim 2, Ryu discloses in Figure 3, further comprising a cap O- ring (33) for airtight.
Ryu does not disclose the O-ring between the cap hemisphere and the cap cylinder.
It would have been obvious to one having ordinary skill in the art before the effective filing date of claimed invention to include O-ring between the cap hemisphere and the cap cylinder to achieve airtight for the radome. Therefore, to employ having the O-ring as claimed invention would have been obvious to person skill in the art.
Allowable Subject Matter
Claims 3-8 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
