Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-22 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claims 1, 13 and 20, the limitation of “providing sufficient support for the cast-in-place, concrete floor to be self-supporting” is not clear as it is not known as to what amount “sufficient” is, and how the floor is “self-supporting”, as a floor is typically supported by a foundation or by columns. It is also not clear as to how the “sufficient support” applies to the floor for the floor to become “self-supporting”. The Applicant should note that these are functional limitations and it is the structural limitations of the claims are being examined. Claims 2-12, 14-19, 21 and 22 are rejected for depending from the above claims.
