DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Drawings
The drawings are objected to because pocket portion 332 is pointed to twice and one leader is pointing to the edge not attached to a pocket. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claims 1-20 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claims 1 and 11, the claim recites “the first pocket portion extends from the first side of the expansion member to form a second opening on a second side of the expansion member so that the user is able to put a second article from the second opening to a second cavity surrounded by a second surface of the pocket portion”. The drawing shows the second opening on the second pocket portion and on the first side not the second side or it is unclear how the second opening would be in the first pocket portion. Additionally, the drawing shows the second pocket portion being located within the first cavity. For purposes of examination the limitation is being interpreted to say “in the second use state, a second pocket portion extends from the first side of the expansion member to form a second opening on the first side of the expansion member so that the user is able to put a second article from the second opening tothe first cavity surrounded by a second surface of the pocket portion”.
Regarding claim 1, the claim recites “the first pocket portion is located in the first storage cavity in the first use state, and the first pocket portion is located outside the first storage cavity in the second use state and communicates with the first storage cavity by using the second opening”. the first pocket portion is located outside the first storage cavity in the second use state and communicates with the first storage cavity by using the second opening. It is unclear how the first pocket portion is located in the first storage cavity in the first use state as it is part of the outer formation of the first storage cavity. The drawings do not show the second opening communicating with the first pocket portion. For purposes of examination the limitation is being interpreted to say “the first pocket portion is located in the first storage cavity in the first use state, and thesecond pocket portion is located in the first storage cavity in the second use state and communicates with the first storage cavity by using the second opening”.
Regarding claim 2, “the first pocket portion is folded and overlapped and connected to a first side of the first connection structure, a fourth edge of the first pocket portion is folded and overlapped and connected to a second side of the first connection structure”. It is unclear how the first pocket portion and fourth edge are folded and overlapped and connected to a first side of the connection structure as it is not show in the drawings. For purposes of examination, the examiner is interpreting the limitation to say ““the first pocket portion is .
Regarding claim 3, the claim recites “a third edge of the second pocket portion is folded and overlapped and connected to the first side of the first connection structure, and a fourth edge of the second pocket portion is folded and overlapped and connected to the second side of the first connection structure” It is unclear how the third and fourth edges are folded and overlapped and connected to a first side of the connection structure as it is not show in the drawings. For purposes of examination, the examiner is interpreting the limitation to say “a third edge of the second pocket portion is ”.
Regarding claim 11, the claim recites “the first pocket portion is located outside the first storage cavity in the second use state and communicates with the first storage cavity by using the second opening”. It is unclear how the first pocket portion is located in the first storage cavity in the first use state as it is part of the outer formation of the first storage cavity. The drawings do not show the second opening communicating with the first pocket portion. For purposes of examination the limitation is being interpreted to say “the second pocket portion is located in the first storage cavity in the second use state and communicates with the first storage cavity by using the second opening”.
Regarding claim 13, the claim recites “a third edge of the first pocket portion is folded and overlapped and connected to a first side of the first connection structure, a fourth edge of the first pocket portion is folded and overlapped and connected to a second side of the first connection structure” It is unclear how the third and fourth edges are folded and overlapped and connected to a first side of the connection structure as it is not show in the drawings. For purposes of examination, the examiner is interpreting the limitation to say “a third edge of the first pocket portion is connected to a first side of the first connection structure, a fourth edge of the first pocket portion is connected to a second side of the first connection structure”.
Claims 4-10, 12,14-20 are rejected due to their dependencies.

It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to modify the accessory expansion member to be an elastic fabric with a stretchable ratio of 1:13. Such a modification involves only a difference in recitation of relative material of the claimed device, and a device having the claimed relative material would not perform differently than the prior art device. Such modification would involve no change in function (see MPEP 2144.07). Further Applicant has not disclosed criticality for the claimed material.

Claim 12 are rejected under 35 U.S.C. 103 as being unpatentable over Kabbani in view of US Publication 2008/0229778 by Shelton (Here forth “Shelton”).

Kabbani does not expressly disclose that the material of the inter layer is waterproof.
Shelton discloses a similar bag that teaches the inter layer being waterproof (Para 36 of Shelton).
It would have been obvious to a person having ordinary skill in the art having the teachings of Kabbani and Shelton before them, when the application was filed, to have modified the luggage of Kabbani to modify the luggage to have the inter layer be waterproof, as taught by Shelton, to advantageously protect the contents within from water damage.
