Continued Examination Under 37 CFR 1.114
A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after allowance or after an Office action under Ex Parte Quayle, 25 USPQ 74, 453 O.G. 213 (Comm'r Pat. 1935). Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, prosecution in this application has been reopened pursuant to 37 CFR 1.114. Applicant's submission filed on 10 June 2026 has been entered.
Information Disclosure Statement
The information disclosure statement (IDS) submitted on 10 June 2026 was filed after the mailing date of the Notice of Allowability on 20 May 2026. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
However, a multitude of references have been struck through as they were already cited in the Notice of Allowability dated 20 May 2026. In the future, it is helpful to have references sorted numerically by date within each category.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 3 & 6-8 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Each of claims 3 & 6 requires “a plurality of adhesive channels connecting the plurality of additional openings,” but it is unclear whether these channels include or preclude those of claim 1 from which each ultimately depends. Claim 7 is rejected as dependent from claim 6 rejected above.
Claim 8 recites “the first and second openings” and it is unclear whether claim 8 now requires more second openings, or if the first opening and the second opening are being lumped together.
Allowable Subject Matter
Claims 1, 4, 5, & 9-20 are allowed.
Claims 3 & 6-8 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
Response to Arguments
Applicant's arguments filed 10 June 2026 have been fully considered but they are not persuasive, as none are found.
