Applicant’s claim for the benefit of a prior-filed application under 35 U.S.C. 119(e) or under 35 U.S.C. 120, 121, 365(c), or 386(c) is acknowledged however it appears that Applicant has filed the present application as a divisional of prior-filed application No. 17581893 as filed 06/02/2025.
This application is claiming the benefit of prior-filed application No. 17581893 under 35 U.S.C. 120, 121, 365(c), or 386(c). Copendency between the current application and the prior application is required. Since the applications are not copending, the benefit claim to the prior-filed application is improper. Applicant is required to delete the claim to the benefit of the prior-filed application, unless applicant can establish copendency between the applications.
The claims withdrawn without traverse in prior-filed application No. 17581893 were already properly filed in a divisional prior-filed application No. 18891588 and allowed.
This application discloses and claims only subject matter disclosed in prior Application No. 18891588, filed 09/20/2024, and names the inventor or at least one joint inventor named in the prior application. Accordingly, this application may constitute a continuation or divisional. Should applicant desire to claim the benefit of the filing date of the prior application, attention is directed to 35 U.S.C. 120, 37 CFR 1.78, and MPEP § 211 et seq. The presentation of a benefit claim may result in an additional fee under 37 CFR 1.17(w)(1) or (2) being required, if the earliest filing date for which benefit is claimed under 35 U.S.C. 120, 121, 365(c), or 386(c) and 1.78(d) in the application is more than six years before the actual filing date of the application.
In the event that the priority status is changed there will still be double patenting issue with prior Application No. 18891588 and the Applicant is advised to file a terminal disclaimer with the priority change. See MPEP 1504.06 regarding double patenting issues and please call Examiner with any questions to expedite prosecution.
Potential Double Patenting based on proper priority
Claims 1, 4, 6 , 8, 10 of this application is patentably indistinct from claim 1, 2, 1, 7, 9 respectively of Application No. 18891588. Pursuant to 37 CFR 1.78(f), when two or more applications filed by the same applicant or assignee contain patentably indistinct claims, elimination of such claims from all but one application may be required in the absence of good and sufficient reason for their retention during pendency in more than one application. Applicant is required to either cancel the patentably indistinct claims from all but one application or maintain a clear line of demarcation between the applications. See MPEP § 822.
