Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
2. The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claim 1-12 is rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention.
Regarding Claim 1, the limitation "initializing a system state" is disclosed. However, in the specification provided, the examiner was unable to find what is a system state. The term 'system state' can be interpreted in many different ways and the examiner is unsure which interpretation is used by the applicant. Similar issues may also be found on Claims 4 and 5.
Dependent Claims 2-10 are also rejected due to their dependency.
Allowable Subject Matter
Claim 1 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Resch (US20120311557) and McMillen (US20090063825) have been found to be the closest prior art.
Resch discloses in Paragraph [0127-0129]: Where the processing module encrypts an encoded data slice of the set of encoded data slices utilizing the secret key. The processing module encrypts the secret key utilizing a public key. The processing module then obtains the public key from a public/private key pair associated with a target entity (e.g., a receiving DS unit). The processing module creates a package that includes the encrypted data slice, the encrypted secret key, a timestamp, a sequence number, and/or an opcode (e.g., write, checked write, delete). The processing module also sends the signed package to a DS unit to facilitate storage of the encrypted data slice and the encrypted secret key. The processing module further sends a certificate chain to the DS unit.
McMillen discloses in Paragraph [0017]: A computerized method of traversing a state machine comprises determining a next character of an input data stream, accessing a first memory associated with a current state of the state machine to determine a transition index associated with the next character, accessing a second memory to determine a unique transition instruction associated with the determined transition index, wherein the unique transition instruction is indicative of a next state and each respective unique transition instruction uniquely identifies a next state for the current state, and selecting a next state indicated in the determined unique transition instruction.
However, Resch, McMillen and known prior art either alone or in combination fails to explicitly teach or suggest the combination of limitations required by Claim 1.
Regarding Claim 1, prior art does not explicitly disclose manipulating said second predetermined amount of data into a second predetermined amount of manipulated data, where said manipulating consists of: rendering deterministic random data based upon said system state, rendering Op Codes based upon said system state, selecting one or more functions from a set of functions, each having an inverse function, by said Op Codes; manipulating said second predetermined amount of data using said one or more functions using at least one bit of said deterministic random data to form a second predetermined amount of manipulated data;
Claims 2-10 would also be allowable due to their dependency to Claim 1.
