Information Disclosure Statement
The information disclosure statement (IDS) submitted on 08/27/25, 06/24/26 and 06/29/26 are in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.

Claims 1-6 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-5 and 7-8 of U.S. Patent No. 11,729,410 in view of Hubrich US 2005/0232357. Although the claims at issue are not identical, they are not patentably distinct from each other because the conflicting claims are not identical in terms of wording and terminology, the scopes of the claims are the same, and they are not patentably distinct from each other as they are obvious variations of one another. U.S. Patent No. 11,729,410 does not recite "wherein the predetermined threshold is determined based on at least one of a width or height of the current block". Hubrich discloses wherein the predetermined threshold is determined based on at least one of a width or height of the current block. [¶ 0024] It would have been obvious to one of ordinary skill in the art before the effective filing date to incorporate the techniques of Hubrich with the teachings of U.S. Patent No. 11,729,410 allowing for improved coding efficiency.
Claims 1-6 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-6 of U.S. Patent No. 12,363,336 in view of Hubrich US 2005/0232357. The method of claim 1, wherein the search area is determined as an area including at least one of a reference block specified by the initial motion information or an adjacent area of the reference block, and wherein the adjacent area is an area extended by N sample lines from a boundary of the reference block.

A method of encoding an image, comprising: determining initial motion information of a current block in the image based on a merge candidate list including a plurality of merge candidates; determining, based on the initial motion information of the current block, a search area for updating the initial motion information of the current block; generating a sum of absolute difference (SAD) list for the se arch area, the SAD list including a plurality of SAD candidates; and deriving delta motion information of the current block based on a SAD candidate of the SAD list, wherein the initial motion information of the current block is updated using the delta motion information, wherein deriving the delta motion information is performed based on a comparison result between a reference SAD candidate and a predetermined threshold, wherein the reference SAD candidate means a SAD candidate corresponding to a non-directional offset, and wherein when the reference SAD candidate is greater than or equal to the predetermined threshold, deriving the delta motion information comprises: identifying a SAD candidate having a minimum value among the SAD candidates belonging to the SAD list; and determining the delta motion information based on an offs et corresponding to the identified SAD candidate.

A method of transmitting a bitstream, comprising: determining initial motion information of a current block based on a merge candidate list including a plurality of merge candidates; determining delta motion information of the current block based on a sum of absolute difference (SAD) list for a search area, the SAD list including a plurality of SAD candidates; updating the initial motion information of the current block based on the delta motion information; generating a prediction block of the current block by performing inter prediction on the current block based on the updated initial motion information; generating a residual block of the current block based on the prediction block; encoding the residual block to generate the bitstream; and transmitting the bitstream, wherein deriving the delta motion information is performed based on a comparison result between a reference SAD candidate and a predetermined threshold, wherein the reference SAD candidate is representative of a SAD candidate corresponding to a non-directional offset, and wherein when the reference SAD candidate is greater than or equal to the predetermined threshold, deriving the delta motion information comprises: identifying a SAD candidate having a minimum value among the SAD candidates belonging to the SAD list; and determining the delta motion information based on an offset corresponding to the identified SAD candidate.

A method of transmitting a bitstream, comprising: determining initial motion information of a current block based on a merge candidate list including a plurality of merge candidates; determining delta motion information of the current block based on a sum of absolute difference (SAD) list for a search area, the SAD list including a plurality of SAD candidates; updating the initial motion information of the current block based on the delta motion information; generating a prediction block of the current block by performing inter prediction on the current block based on the updated initial motion information; generating a residual block of the current block based on the prediction block; encoding the residual block to generate the bitstream; and transmitting the bitstream, wherein deriving the delta motion information is performed based on a comparison result between a reference SAD candidate and a predetermined threshold, wherein the reference SAD candidate is representative of a SAD candidate corresponding to a non-directional offset, wherein the predetermined threshold is determined based on at least one of a width or height of the current block, and wherein when the reference SAD candidate is greater than or equal to the predetermined threshold, deriving the delta motion information comprises: identifying a SAD candidate having a minimum value among the SAD candidates belonging to the SAD list; and determining the delta motion information based on an offset corresponding to the identified SAD candidate.

A non-transitory computer-readable medium for storing data associated with a video signal, comprising: a data stream stored in the non-transitory computer-readable medium, the data stream comprising a current block encoded by inter prediction, wherein initial motion information of the current block is up dated, based on delta motion information of the current block, for the inter prediction of the current block, wherein the initial motion information is derived based on a merge candidate list including a plurality of merge candidates, wherein a search area for updating the initial motion information is determined based on the initial motion information of the current block, wherein a sum of absolute difference (SAD) list for the search area is generated to update the initial motion information of the current block and the SAD list includes a plurality of SAD candidates, wherein the delta motion information of the current block is derived based on a SAD candidate of the SAD list, wherein the delta motion information is derived based on a comparison result between a reference SAD candidate and a predetermined threshold, wherein the reference SAD candidate means a SAD candidate corresponding to a non-directional offset, and wherein when the reference SAD candidate is greater than or equal to the predetermined threshold, the delta motion information is derived by identifying a SAD candidate having a minimum value among the SAD candidates belonging to the SAD list and determining the delta motion information based on an offset corresponding to the identified SAD candidate.
