DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The Information Disclosure Statements filed on 6/24/2026 and 9/30/2026 have been entered and considered. Initialed copies of the form PTO-1449 are enclosed with this action. Restriction/Status of claims On 9/9/2026, the applicant elected Group I, claims 1-14, with traverse. The applicant argues that Groups I and II are unified, thus the unity of invention applies. The argument is not deemed persuasive, because the application is not a PCT application, the Unity of Invention does not apply. Nevertheless, upon further consideration, the application is a CON application. Thus, for compact prosecution, the restriction is withdrawn. Group II is rejoined and examined in the office action. In summary, claims 1-29 are pending and examined in the office action. Priority Instant application 19234655, filed 06/11/2025, is a Continuation of 18586110, filed 02/23/2024, now U.S. Patent 12516342. 18586110 is a Continuation of 17733561, filed 04/29/2022, now U.S. Patent 11913009. 17733561 is a Divisional of 16896682, filed 06/09/2020, now abandoned. 16896682 Claims Priority from Provisional Application 62912010, filed 10/07/2019, and claims Priority from Provisional Application 62866872, filed 06/26/2019. Instant SEQ ID NO: 14 is a polynucleotide of 423 bp, instant SEQ ID NO: 15 is a polypeptide of 140 aa. However, 62912010 disclosed SEQ ID NOs: 1-16 (pages 101-111 of the specification). 62866872 disclosed SEQ ID NOs: 1-16 (pages 24-30 of the specification). SEQ ID NO: 14 in both 62866872 and 62912010 is a polynucleotide of 595 bp. SEQ ID NO: 15 in both 62866872 and 62912010 is a polynucleotide of 383 bp. Therefore, the provisional applications did not disclose instant SEQ ID NOs: 14 and 15. 16896682 disclosed the claimed subject matter including SEQ ID NOs: 14 and 15. Therefore, the priority date of all pending claims is 06/09/2020. Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the claims at issue are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); and In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on a nonstatutory double patenting ground provided the reference application or patent either is shown to be commonly owned with this application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. The instant application and the US Patents share the same inventor and the same applicant Eg Crop Science Inc. Claims 1-29 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-22 of US Patent 11913009. The US patent (reference) claims: Claim 1. A nucleic acid construct comprising a nucleic acid sequence coding a peptide conferring resistance to Fusarium oxysporum race 4 when expressed in a banana plant, wherein said nucleic acid sequence is selected from the group consisting of a nucleic acid sequence having at least 97% sequence identity to SEQ ID NO: 9 and SEQ ID NO: 11 wherein nucleotide positions 148, 323, 344, and 347 of the nucleic acid sequence are G, A, C, and T, respectively, and wherein the nucleic acid sequence is operably linked to a promoter capable of driving expression of the nucleic acid sequence. Claim 3. A transgenic banana plant, plant part, plant cell, or plant tissue culture comprising a nucleic acid construct comprising a nucleic acid sequence coding a peptide conferring resistance to Fusarium oxysporum race 4 when expressed in a plant, wherein said nucleic acid sequence is selected from the group consisting of a nucleic acid sequence having at least 97% sequence identity to SEQ ID NO: 9 and SEQ ID NO: 11, wherein nucleotide positions 148, 323, 344, and 347 of the nucleic acid sequence are G, A, C, and T, respectively, and wherein the nucleic acid sequence is operably linked to a promoter capable of driving expression of the nucleic acid sequence. Claim 4. A method of transforming a banana plant cell comprising introducing the nucleic acid construct of claim 1 into a plant cell, whereby the transformed plant cell expresses the nucleic acid sequence coding a peptide conferring resistance to Fusarium oxysporum race 4. Claim 15. A nucleic acid construct comprising a nucleic acid sequence coding a peptide conferring resistance to Fusarium oxysporum race 4 when expressed in a banana plant, wherein the nucleic acid sequence is operably linked to a promoter capable of driving expression of the nucleic acid sequence, wherein amino acid positions 50, 108, 115, and 116 of the peptide are Valine, Glutamic Acid, Proline, and Valine, respectively, and wherein said peptide has an amino acid sequence having at least 97% sequence identity to SEQ ID NO: 12. Although the claims at issue are not identical, they are not patentably distinct from each other because: Regarding SEQ ID NOs: 14 and 15, by sequence search and alignment by the examiner, reference SEQ ID NO: 9 has 98.1% sequence identity to instant SEQ ID NO: 14. Reference SEQ ID NO: 11 has 97.7% sequence identity to instant SEQ ID NO: 14. Both reference sequences have 148, 323, 344, and 347 of the nucleic acid sequence are G, A, C, and T. See “Sequence Matches” at the end of office action. Thus, the reference sequences include instant SEQ ID NO: 14, and critically have the exact G, A, C, and T in the exact positions of 148, 323, 344, and 347 of instant SEQ ID NO: 14. In addition, instant SEQ ID NO: 15 (instant claim 4) is encoded by instant SEQ ID NO: 14. Reference SEQ ID NO: 12 has 97.0% sequence identity to instant claim 15, and has the exact Valine, Glutamic Acid, Proline, and Valine in positions 50, 108, 115, and 116 of instant SEQ ID NO: 15. See “Sequence Matches” at the end of office action. In another word, instant SEQ ID NOs: 14 and 15 are within the claimed sequences of reference US Patent. Moreover, instant claim 1 only claims one of the 4 mutants (not all 4); instant claim 4 also only claims one of the 4 mutants (not all 4). Thus, reference claims recite the sequences in a narrower and more specific manner. Regarding the methods of instant claims 1, 4 and 15-16, 19, reference claim 4 recites a method of transforming a banana plant cell comprising introducing the nucleic acid construct of claim 1 into a plant cell, whereby the transformed plant cell expresses the nucleic acid sequence coding a peptide conferring resistance to Fusarium oxysporum race 4. Reference claim 15 recites a construct that is used in the method of claim 1. Thus, reference claims 4 and 15 teach instant claims 1 and 4 in a narrower and more specific manner. Since making mutants is a way of silencing a gene/sequence, the reference claims teach instant claims 15-16, 19 in a narrower and more specific manner. In addition, reference claim 4 recites conferring resistance to Fusarium oxysporum race 4, which teaches the exact intended purpose of instant claims. Regarding dependent claims, reference claims 5-11, 14 teach or suggest the limitations of instant claims 5-14, 20-29. The reference application does not claim the subject matter of instant claims 2-3, 17-18, “genetic modification is introduced by a TALEN, a meganuclease, a zinc finger nuclease or a CRISPR-associated nuclease”, and “an associated guide RNA”. Using CRISPR and associated guide RNA to make gene mutations and/or silence genes had been routine and taught. For example, Niu et al (CA 3051585, published 8/2/2018) teach, demonstrate and claim a method of mutating and/or silencing genes including in Musa plant, by using CRISPR and associated guide RNA for disease resistance including fungal resistance ([0106], [0112], [0120], [0130], Example 2 in [0159]-[0166], claim 9). Thus, in view of Niu et al, instant claims 2-3, 17-18 are deemed obvious. Therefore, the reference and instant claims are obvious over each other. Claims 1-29 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-18 of US Patent 12516342. The USP (reference) claims: Claim 1. A nucleic acid construct coding a peptide conferring resistance to Fusarium oxysporum race 4 when expressed in a banana plant, wherein amino acid positions 50, 108, 115, and 116 of the peptide are Valine, Glutamic Acid, Proline, and Valine, respectively, and wherein said peptide has an amino acid sequence having at least 97% sequence identity to SEQ ID NO: 12, and wherein the amino acid sequence is encoded by a nucleic acid sequence that is operably linked to a promoter capable of driving expression of the amino acid sequence. Claim 3. A transgenic banana plant, plant part, plant cell, or plant tissue culture comprising a nucleic acid construct coding a peptide conferring resistance to Fusarium oxysporum race 4 when expressed in a plant, wherein amino acid positions 50, 108, 115, and 116 of the peptide are Valine, Glutamic Acid, Proline, and Valine, respectively, and wherein said peptide has an amino acid sequence having at least 97% sequence identity to SEQ ID NO: 12, and wherein the amino acid sequence is encoded by a nucleic acid sequence that is operably linked to a promoter capable of driving expression of the amino acid sequence. Claim 4. A method of transforming a banana plant cell comprising introducing the nucleic acid construct of claim 1 into a plant cell, whereby the transformed plant cell expresses the nucleic acid sequence coding a peptide conferring resistance to Fusarium oxysporum race 4. Claim 14. A method for producing and selecting a banana plant resistant to Fusarium oxysporum race 4, said method comprising: a) crossing the mature transformed banana plant of claim 3 with another different banana plant, b) harvesting the resultant banana seed, c) growing the seed from step b) to produce progeny banana plants, d) screening the progeny banana plants from step c) for resistance to Fusarium oxysporum race 4, and e) selecting progeny banana plants resistant to Fusarium oxysporum race 4. Although the claims at issue are not identical, they are not patentably distinct from each other because: By sequence search and alignment by the examiner, reference SEQ ID NO: 9 (not claimed) has 98.1% sequence identity to instant SEQ ID NO: 14, and has the exact 148, 323, 344, and 347 of the nucleic acid sequence are G, A, C, and T of instant SEQ ID NO: 14. See “Sequence Matches” at the end of office action. In addition, instant SEQ ID NO: 15 (instant claim 4) is encoded by instant SEQ ID NO: 14. Reference SEQ ID NO: 12 has 97.0% sequence identity to instant claim 15, and has the exact Valine, Glutamic Acid, Proline, and Valine in positions 50, 108, 115, and 116 of instant SEQ ID NO: 15. See “Sequence Matches” at the end of office action. In another word, instant SEQ ID NO: 15 is within the claimed sequences of reference US Patent. The US Patent also teaches the encoding sequence of instant SEQ ID NO: 14. Moreover, instant claim 1 only claims one of the 4 mutants (not all 4); instant claim 4 also only claims one of the 4 mutants (not all 4). Thus, reference claims recite the sequences in a narrower and more specific manner. Regarding the methods of instant claims 1, 4 and 15-16, 19, reference claim 4 recites a method of transforming a banana plant cell comprising introducing the nucleic acid construct of claim 1 into a plant cell, whereby the transformed plant cell expresses the nucleic acid sequence coding a peptide conferring resistance to Fusarium oxysporum race 4. Remarks Prior art does not teach SEQ ID NO: 14 (423 bp) or 15 (140 AA). The closest sequence matches are in the “Sequence Matches” below. Accordingly, the applicant first discovered the sequence and encoding sequence. Prior art does not teach or suggest making the specific mutations at the specific positions of SEQ ID NO: 14 or 15, nor silencing SEQ ID NO: 14 or 15. The following reference is relevant to instant application, thus are filed but not cited by examiner: Van Den Berg et al (Tolerance in banana to Fusarium wilt is associated with early up-regulation of cell wall-strengthening genes in the roots. MOLECULAR PLANT PATHOLOGY, 333–341, 2007). The reference teaches an aa sequence matches 96.8% to instant SEQ ID NO: 15. See “Sequence Matches” at the end of office action. Van Den Berg et al also teach that Fusarium wilt, caused by the fungal pathogen Fusarium oxysporum race 4 is one of the most destructive diseases in bananas (p333, whole left col).
