Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Drawings
The drawings are objected to because in FIG. 4 “123” isn’t pointing to notches, as “123” is defined in the Specification.
Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Specification
The abstract should be in narrative form and generally limited to a single paragraph on a separate sheet within the range of 50 to 150 words in length. The abstract should describe the disclosure sufficiently to assist readers in deciding whether there is a need for consulting the full patent text for details.
The language should be clear and concise and should not repeat information given in the title. It should avoid using phrases which can be implied, such as, “The disclosure concerns,” “The disclosure defined by this invention,” “The disclosure describes,” etc. In addition, the form and legal phraseology often used in patent claims, such as “means” and “said,” should be avoided.
The abstract of the disclosure is objected to because it is too short. A corrected abstract of the disclosure is required and must be presented on a separate sheet, apart from any other text. See MPEP § 608.01(b).
Claim Objections
Claim 18 is objected to because of the following informalities: the body of the claim is currently one large paragraph. However, where a claim sets forth a plurality of elements or steps, each element or step of the claim should be separated by a line indentation, 37 CFR 1.75(i). Also in claim 18, line 5 should likely be amended to recite --portion, [[and ]]a solid-- and the second to last line should likely be amended to recite --portion, and a shoulder--. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claim 26 is rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention.
Claim 26 recites the limitation "said at least one additional thread" in lines 1-2. There is insufficient antecedent basis for this limitation in the claim.
Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.

Claim 18 is rejected on the ground of nonstatutory double patenting as being unpatentable over claims 4 and 14 of U.S. Patent No. 11,732,547 B2. Although the claims at issue are not identical, they are not patentably distinct from each other because the claim limitations in present claim 18 are already required in patented claims 4 and 14, and more specifically in claim 14.
Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
This application currently names joint inventors. In considering patentability of the claims the examiner presumes that the subject matter of the various claims was commonly owned as of the effective filing date of the claimed invention(s) absent any evidence to the contrary. Applicant is advised of the obligation under 37 CFR 1.56 to point out the inventor and effective filing dates of each claim that was not commonly owned as of the effective filing date of the later invention in order for the examiner to consider the applicability of 35 U.S.C. 102(b)(2)(C) for any potential 35 U.S.C. 102(a)(2) prior art against the later invention.
Claim 18 is rejected under 35 U.S.C. 103 as being unpatentable over SPENCER (US 2010/0155085 A1), alone.
Spencer teaches formation plug formed in situ in a wellbore traversing a formation, comprising:
solid bismuth alloy material 122 having a solid first cylindrical body portion (where “122” is pointing in FIG. 3), a solid second cylindrical body portion (above the first cylindrical body portion in FIG. 3) of smaller diameter than the first cylindrical body portion, a shoulder being defined at a transition from said first cylindrical body portion to said second cylindrical body portion (FIG. 3).
While the plug material taught by Spencer more than likely seeps out into the formation in a web shape before solidifying, Spencer does not specifically teach said plug comprises a dendritic web extending outwardly from and around at least a portion of said solid first cylindrical body portion. It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to have modified the plug taught by Spencer to have a web with a reasonable expectation of success in order to have a firmer hold into the formation.
Claims 19 and 20 are rejected under 35 U.S.C. 103 as being unpatentable over Spencer and in view of Boyd et al. (US 5,667,010) (“Boyd”).
Referring to claims 19 and 20: Spencer does not specifically teach a conical portion extending from an end of said first cylindrical portion, or said shoulder is tapered. Boyd teaches a formation plug formed in situ in a wellbore traversing a formation, comprising a material having a solid first cylindrical body portion (at “32” in FIG. 3) and a second cylindrical body portion (adjacent to plug “30”) of a smaller diameter than the first cylindrical body portion, a shoulder being defined at a transition from said first cylindrical body portion to said second cylindrical body portion (FIG. 3), further comprising a conical portion extending from an end of said first cylindrical portion (at the lower end of said first cylindrical portion), and wherein said shoulder is tapered (FIG. 3). It would have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to have modified the end of the first cylindrical portion and shoulder taught by Spencer to be conical and tapered, respectively, as taught by Boyd with a reasonable expectation of success to help retain the plug so that it will not be displaced should the casing and sheath below the cement layer break down (Boyd - column 5, lines 18-21).
Allowable Subject Matter
Claims 21-25 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
Claim 26 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Mueller et al. (US 11,377,925 B2) teaches a formation plug formed in situ in a wellbore traversing a formation, comprising a bismuth alloy material (Abstract). Surjaatmadja et al. (US 9,359,848 B2) teaches a formation plug formed in situ in a wellbore traversing a formation, comprising a cement material 402 with two different diameter portions (FIG. 4C).
