Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. The following patents and papers are cited to further show the state of the art at the time of Applicants’ invention with respect to personalization and customizable filtering of network search results and search result rankings, such as for Internet searching which comprises: a network interface to receive a query from a respondent or co-respondent; at least one data storage device storing a plurality of return queries; and one or more processors adapted to access the data storage device and using the query, to select the return queries for transmission; to search the data storage device for corresponding pluralities of responses to the return queries from other co-respondents or respondents; to pair-wise score the responses and generate pair-wise alignment scores for respondent and co-respondent combinations; to sort and rank the combinations according to the alignment scores; and to output a listing of the sorted and ranked respondents or co-respondents to form the personalized network search results and search result rankings.

Boulder Gareth Jones (US PGPUB 2011/0301858, hereafter Jones); “Systems and Methods For Computer Assisted Alignment Of Conformers” discloses “ receive a first data structure describing a plurality of conformers for each biologically active molecule; receive a second data structure describing a plurality of pair-wise conformer alignments and a similarity score for each pair-wise conformer alignment; compute a fitness score of the plurality of conformers based on the similarity score and a penalty score based on geometric properties of each biologically active molecule; and generate a predictive overlay of a plurality of ligands by selecting one or more conformers from each ligand conformer library and combining those conformers into an overlay so as to attempt to reproduce pair-wise alignments between those conformers”.
Jones also teaches pair-wise alignments and scores for every pair of conformers in CF [0040] and pair-wise alignments and scores for every pair of conformers in CF [0043].
Jones further teaches scored pair-wise alignments and associated similarity scores are generated between all pairs of conformers in the libraries [0069].
b. Zhou et al. (US PGPUB 2007/0244651, hereinafter Zhou); “Structure-Based Analysis For Identification Of Protein Signatures: CUSCORE discloses “products for scoring polypeptide residues that combine the use of a structure-based alignment with a method of selecting against confounding proteins. The scores can be used to identify protein signatures of interest that are useful, e.g., as targets in developing highly specific ligands for diagnostic or therapeutic uses”.
Zhou further discloses calculating a conservation-uniqueness score from a set of aligned three dimensional structures comprising positional information for a plurality of residues [0009].
Zhou also teaches calculation of an optimal pairwise alignment score. The matrix field (i,j) is the score assigned to the optimal alignment between two residues (up to a total of i by j residues) from the input sequences. Each entry is calculated from the top-left neighboring entries by way of a recursive equation [0030].
