Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1, 7-8, 11 and 14-15 are rejected under 35 U.S.C. 102(b) as being anticipated by Carmichae et al (US 20140282454 A1).
With respect to claims 1, 8 and 15, Carmichae et al teaches
storing objects each having a unique name in a namespace of a first bucket and files in a second bucket of a first storage cluster of the distributed storage system accessing the objects and files through an object storage protocol (OSP) ([0005] storage cluster, a cluster file system. bucket sets define file system. file systems used for storing objects namespace that is used for accessing objects);

With respect to claim 11, Carmichae et al teaches perform a switchover process from the first storage cluster to the second storage cluster; and initiate an audit job on the second storage cluster based on the audit configuration during the switchover process, wherein the first storage cluster initially handles input/output operations for a software application before the switchover process ([0069] FIG. 4 the hierarchical relationship between tenants, appliances, and storage pools in an EOS system, in accordance with one embodiment of the present disclosure. application associated with a tenant, one or more appliances, and one or more storage pools for storing data may be implemented within the EOS system 300 of FIG. 3).
Allowable Subject Matter
Claims 2-6, 9-10, 12-13 and 16-20 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
