The claim is directed to an abstract idea. See 2019 Revised Patent Subject Matter Eligibility Guidance, Step 2A, Prong Two. See also MPEP 2106.04(II)(A)(2), MPEP 2106.04(d). The claim does not include additional elements that are sufficient to amount to significantly more than the judicial exception. These additional elements cannot provide an inventive concept. Allowable Subject Matter
Claims 1-20 are allowable over the prior art but have outstanding 35 USC 101 rejections that must be resolved.
Response to Arguments
Applicants’ arguments with respect to the 35 USC 101 rejections have been fully considered but they are not persuasive.
Applicant argues that “the claims do not recite a mental process when they contain limitations that cannot practically be performed in the human mind” because the amended claims specify “one or more processors in connection with operations for obtaining, querying, identifying and scanning of a connection to a client by a cloud service system and control for disconnecting the connection to the client in response to a condition being met” and that “[u]nlike simple gathering of data, control and operations performed by one or more processors of a cloud management platform constitute specific, non-generic technology that requires specialized hardware and cannot be performed mentally or with pen and paper” and cites paragraphs from the specification outlining hardware configurations and various court findings discussing patent-eligible subject matter (see applicant arguments, pages 10-13). However, nothing in paragraphs of the specification cited by the applicant would be considered specialized hardware but just describes generic embodiments that are typically found in various configures commonly used. In addition, the court findings cited by the applicant are driven by their underlying fact patterns that are nothing like the generic use of hardware found in the claimed subject matter here. Therefore, these arguments are not convincing.
Applicant argues that “the claims integrate any such alleged abstract idea into a practical application of a cloud service control plane that may quickly shut down computing clusters that have not finished running, to reduce cloud resources, thereby reducing costs of the user, thereby resulting in an improvement to a technological process” as evidenced by paragraph [0118] that discloses improving speed and efficiency “without compromising target data matching accuracy, and paragraph [0064] that teaches similar improvements with respect to identifying the target data in to-be-scanned data (see applicant arguments, pages 13-15). However, for integration into a practical application under the 2019 PEG, Step 2A, Prong Two, the applicant must identify whether the claim recites any additional elements beyond the judicial exception, and evaluate those additional elements individually and in combination to determine whether they integrate the judicial exception into a practical application, using one or more of the considerations in MPEP §§ 2106.04(d), 2106.05(a)-(c), (e)-(h). The applicant makes no mention of any of the additional elements identified in the rejections of record nor any discussion of how they integrate the judicial exception into a practical application. While the applicant does discuss improvements to the functioning of a computer or technical field that is a consideration under MPEP 2106.05(a), this consideration requires not only that the specification includes a technical explanation of an asserted improvement, but that the claim reflects the particular way of achieving that improvement. The claims do not disclose any of the speed or efficiency improvements discussed in the specification, so the consideration described in MPEP 2106.05(a) was also not met. Therefore, these arguments are not convincing.
Conclusion
THIS ACTION IS MADE FINAL. Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
