Claim Rejections - 35 USC § 103 :AIA
5. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
(a) A patent may not be obtained though the invention is not identically disclosed or described as set forth in section 102 of this title, if the differences between the subject matter sought to be patented and the prior art are such that the subject matter as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which said subject matter pertains. Patentability shall not be negatived by the manner in which the invention was made.
The factual inquiries set forth in Graham v. John Deere Co., 383 U.S. 1, 148 USPQ 459 (1966), that are applied for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows:
1. Determining the scope and contents of the prior art.
2. Ascertaining the differences between the prior art and the claims at issue.
3. Resolving the level of ordinary skill in the pertinent art.
4. Considering objective evidence present in the application indicating obviousness or nonobviousness.
6. Claims 10, 22 is/are rejected under 35 U.S.C §103 unpatentable over LIU et al. (US 20250254298 A1: refer to its PCT filed on April 12th, 2023) in view of ANDERSSON et al. (US 20250071283 A1: refer to its PCT filed on December 14th, 2022).
Regarding claim 10, LIU et al. (US 20250254298 A1: refer to its PCT filed on April 12th, 2023) discloses the following claim limitations as set forth in claim 8.
In the same field of endeavor, ANDERSSON et al. (US 20250071283 A1: refer to its PCT filed on December 14th, 2022) discloses the deficient claim limitations, as follows:
The method of claim 8, wherein the control data comprises a slice quantization parameter value [i.e. an input of a NN is a slice quantization parameter; paragraph. 0054].
It would have been obvious to one with ordinary skill in the art before the filing date of the invention to modify the teachings LIU et al. (US 20250254298 A1: refer to its PCT filed on April 12th, 2023) ANDERSSON et al. (US 20250071283 A1: refer to its PCT filed on December 14th, 2022) in order to create a decoding method as the claimed invention.
Regarding claim 22, all the claim limitations which are set forth and rejected as per discussion for claim 10.
Allowable Subject Matter
Claims 7, 11, 19, 23 objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
