The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Response to Amendment
Pursuant to the applicant’s response filed 28 July 2026, the amendments to the claims have been entered into this application. By this amendment, claim 3 has been cancelled, no claims have been added, and claims 1-2 & 4 are currently pending in the application. The previously noted section 112 rejections have been overcome by the amendments and are hereby withdrawn. The section 102 rejections have been revised to address the changes to the claims.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
Claim(s) 1-2 and 4 is/are rejected under 35 U.S.C. 102(a)(1) as being clearly anticipated by U.S. Patent 7,213,519 issued to Wiley et al (Wiley).
Regarding claim 1, Wiley discloses an ammunition cartridge comprising a head portion and a body portion (See at least Figures 14A-17C), said head portion having one end formed by a ring (310), said ammunition cartridge being characterized by the body portion and the head portion made in a single piece (See at least Figure 14C, clearly illustrated) and comprising a metal insert (368) in the head portion; wherein the metal insert comprises a concave cylindrical portion, a straight cylindrical portion located around the primer pocket, and a flat portion aligned with a flash hole (See at least Figures 15C and 16C, all aspects clearly illustrated).
Regarding claim 2, Wiley further discloses wherein the single piece which makes up said ammunition cartridge is made of a material comprising a single polymer (See at least Col. 9 Line 60-Col. 10 Line 7) or a mixture of two polymers A and B, wherein, when said ammunition cartridge comprises the mixture of two polymers A and B, said ammunition cartridge comprises the head portion comprised from polymer B, followed by a merging region of polymers (AB) for the remainder of the body of the ammunition cartridge comprises the polymer A.

Response to Arguments
In response to the applicant’s arguments that Wiley does not disclose the claimed features of the insert, without conceding the earlier rejection, the examiner has updated the rejection to specifically reference the details as shown in Figures 14A-16C that appear to have the claimed features. Therefore, the rejection is maintained by the examiner.

THIS ACTION IS MADE FINAL. Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
