Office Action

§101 §102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Status of Claims This action is in reply to non-provisional patent application filed on 7/11/25 and IDS filed on 6/17/26. Claims 1-20 are pending and examined. Information Disclosure Statement The information disclosure statement (IDS) was submitted on 6/17/26. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement was considered by the examiner. Priority Acknowledgment is made of applicant’s claim for foreign priority under 35 U.S.C. 119 (a)-(d). The certified copy has been filed in parent Application No. CN202310591075.0, filed on 5/23/23. Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claims 1-20 are rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more. (Step 1) The claims 1-12 and 16-20 recite a process (claims 1-12), an apparatus (claims 16-20). For the purposes of this analysis, representative claim 16 is addressed (from claims 1 and 16). (Step 2A, prong 1) Abstract ideas are in bold below, and represent organizing human activity as a method of authorizing a party to a financial transaction through a biological feature of the party (see FIG.s 1-24 and abstract), as are all a form of commercial or legal interactions and managing personal behavior or relationships or interactions between people. An interactive device of service processing, comprising processing circuitry configured to, obtain a configuration information set of a target merchant; execute embedded general-purpose code with one or more configuration fields being set according to one or more configuration field values from the configuration information set; display a service main page based on the configuration information set; obtain target biological information of a target object by using a collection apparatus of the interactive device in response to an information collection prompt on the service main page; and when a biological recognition service is not enabled on a target object account of the target object and in response to a notification indicative of an authorized enabling operation on a target user terminal that is logged in the target object account, display a service enabling page that indicates the biological recognition service is enabled, the biological recognition service supporting a service based on a biological information recognition result. (Step 2A prong 2) The additional elements are as follows: “An interactive device of service processing, comprising processing circuitry configured”. These additional elements do not integrate the abstract idea into a practical application as they are no more than “apply it” because they are mere “[u]se of a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2). “execute embedded general-purpose code”. These additional elements do not integrate the abstract idea into a practical application as they are no more than “apply it” because they are mere “[u]se of a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2). “display a service main page”. These additional elements do not integrate the abstract idea into a practical application as they are no more than “apply it” because they are mere “[u]se of a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2). “[obtain …] using a collection apparatus of the interactive device in response to an information collection prompt on the service main page”. These additional elements do not integrate the abstract idea into a practical application as they are no more than “apply it” because they are mere “[u]se of a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2). Furthermore, “using a collection apparatus of the interactive device” does not integrate the abstract idea into a practical application as it is no more than “apply it” because the claim fails to recite the technological details of how biologically identifying information is obtained using the collection apparatus, see MPEP 2106.05(f)(1). “when a biological recognition service is not enabled “…” an authorized enabling operation on a target user terminal that is logged in […], display a service enabling page that indicates the biological recognition service is enabled, the biological recognition service supporting a service […]”. These additional elements do not integrate the abstract idea into a practical application as they are no more than “apply it” because they are mere “[u]se of a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2). (Step 2B) The claim does not include additional elements that are sufficient to amount to significantly more than the judicial exception. As discussed above with respect to integration into a practical application, the additional elements do no more than provide mere instructions to apply the abstract idea using “a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2), and/or the claim fails to recite the technological details of “how a solution to a problem is accomplished”, see MPEP 2106.05(f)(1). Therefore, the claim elements when considered separately and in an ordered combination, do not add significantly more than implementing the abstract idea of authorizing a party to a financial transaction through a biological feature of the party. Furthermore, claims 13-15 recite another process. For the purposes of this analysis, representative claim 13 is addressed. (Step 2A, prong 1) Abstract ideas are in bold below, and represent organizing human activity as a method of authorizing a party to a financial transaction through a biological feature of the party (see FIG.s 1-24 and abstract), as are all a form of commercial or legal interactions and managing personal behavior or relationships or interactions between people. obtaining, by a terminal device and in response to a configuration operation, a configuration information set of a target merchant, the target merchant having a target merchant identifier; and transmitting the configuration information set and the target merchant identifier to a server to cause the server to store the configuration information set of the target merchant identifier; wherein when an interactive device obtains the configuration information set of the target merchant, the interactive device: executes embedded general-purpose code with one or more configuration fields being set according to one or more configuration field values from the configuration information set, displays a service main page based on the configuration information set, obtains target biological information of a target object in response to an information collection prompt on the service main page, and when a biological recognition service is not enabled on a target object account of the target object and in response to a notification indicative of an authorized enabling operation on a target user terminal that is logged in the target object account, display a service enabling page that indicates the biological recognition service is enabled, the biological recognition service supporting a service based on a biological information recognition result (Step 2A prong 2) The additional elements are as follows: “[obtaining], by a terminal device and in response to a configuration operation”. These additional elements do not integrate the abstract idea into a practical application as they are no more than “apply it” because they are mere “[u]se of a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2). “transmitting … to a server to cause the server to store []”. Transmitting and storing information do not integrate the abstract idea into a practical application as they are no more than “apply it” because they are mere “[u]se of a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2). “wherein when an interactive device obtains […]”. Obtaining information does not integrate the abstract idea into a practical application as it is no more than “apply it” because it is mere “[u]se of a computer or other machinery in its ordinary capacity for economic or other tasks”, see MPEP 2106.05(f)(2). Analysis of dependent claims 2-12, 14-15 and 17-20 recited additional details which only further narrow the abstract idea and do not add any additional features, alone or in combination, that would provide a practical application or provide significantly more. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
