Office Action

§101 §103
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefore, subject to the conditions and requirements of this title. Step 1: Claims 1-17 are a method, claims 18-19 are a system and claim 20 media. Thus, each independent claim, on its face, is directed to one of the statutory categories of 35 U.S.C. §101. However, the claims 1-20 are rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more. Step 2A-Prong 1: Independent claims 1, 18 and 20 recite displaying a first social status posted by the first user account, a posting location of the first social status being a first location; and displaying, when a positioning location of the client moves from an outside of a geographical area including a first location into the geographical area, a second social status automatically posted by the client, status information of the second social status being determined based on status information of the first social status. These limitations as drafted is a process, that under its broadest reasonable intepration, covers sharing and updating status messages based on location, which falls into a method of organizing human activity. The claim is typically mapped to an abstract idea, such as "commercial or social interactions" or “and reporting information regarding location." A person could conceptually track their location and manually post a matching status update using pen and paper or thought processes. Thus, this limitation is also mental processes. Simply put, these limitations merely describe collecting, analyzing, and displaying location-based status data, which is clearly a business arrangement in its purest form. Claims 2-17 and 19 merely provide additional abstract concepts and narrow the abstract idea of claims 1, 18 and 20. Futher claims 1-20 are recited at such a high level that the claimed steps amount to no more than a mental processes, such as concept performed in the human mind (including an observation, evaluation, judgement, opinion) because a human can manually post information based on identified geographic location. Step 2A-Prong 2: the claims recite additional elements of generic client devices, positioning units, and display screen is viewed as mere "extra-solution activity" or applying an abstract concept in a generic technological environment. The examiner evaluates whether the abstract idea is integrated into a practical application. Reciting generic client devices, positioning units, and display screens is viewed as mere "extra-solution activity" or applying an abstract concept in a generic technological environment. This generic processor limitation is no more than mere instructions to apply the exception using a generic computer component. Accordingly, this additional element does not integrate the abstract idea into a practical application because it does not impose any meaningful limits on practicing the abstract idea. The claims are directed at the abstract idea. Step 2B: As discussed with respect to Step 2A Prong Two, the additional element in the claim amounts to no more than mere instructions to apply the exception using a generic computer component. The same analysis applies here in 2B, i.e., mere instructions to apply an exception using a generic computer component cannot integrate a judicial exception into a practical application at Step 2A or provide an inventive concept in Step 2B. The claim is ineligible. Claim Objections Claim 13 is objected to as being dependent upon a rejected base claim but would be allowable if rewritten in independent form including all the limitations of the base claim and any intervening claims. Claim 13 is objected to as being rejected under 35 U.S.C 101 but would be allowable if it amended to overcomes the 35 U.S.C 101 rejections. Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. Claim(s) 1-8, 11 and 14-20 is/are rejected under 35 U.S.C. 103 as being unpatentable over Baalu et al (US Pub., No., 2012/0158845 A1) in view of Rathod (US Pub., No. 2016/0255139 A1) With respect to claim 1, Baalu teaches a social status posting method, performed by a client running on a computer device and logged in using a first user account(paragraphs [0005]-[0006], discloses computer implemented method of autotmcially posting user-locations information to a social network.., location update is automatically posted to the social network if at least one location update conduction is met.., paragraph [0013], discloses methods and system that are capable of automatically interfacing with internet-based social network for safely providing a mobile user’s friends with the location-aware updates and paragraph [0021], dislcies pre-programmed user data can include social network login information ), the method comprising: displaying a first social status posted by the first user account, a posting location of the first social status being a first location (paragraph [0028], discloses user’s system posting location aware updates…, paragraph [0032], discloses obtain friends data, including friend location data, form the social networking .., and paragraph [0033], discloses after getting the location data .., a check is made to see whether an auto update condition is met..); and Baalu teaches the above elements including displaying, when a positioning location of the client moves from an outside of a geographical area including a first location into the geographical area, a second social status automatically posted by the client(paragraph [0031], discloses a mobile user is moving may be continually or periodically updated and translates the signal into message for processor .., signal might represent a longitude and latitude or some other geo specific identifier, paragraph [0032], discloses location data such as nearby location or address of a friends, then navigation engine could insert a friend icon (identifying a friend location relative to the mobile user) onto the navigation map display indicating to the mobile user that a friend is nearby and paragraph [0033], discloses after getting the location data at step a check is made to see whether an auto update condition is met , if a condition is met, then an auto update post is made at step…, ).
