Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-15 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 reciting “a display device” comprising “a panel”, “a frame” and “a communication box” is indefinite, since it’s unclear how a display device is obtained absent a back cover. All embodiments of the invention, e.g., Figs. 1-3, depict a display device 1 comprising display panel 10, a frame 20, a side frame 30, a back cover 40, and a communication box 100.
Claim 1 further reciting “wherein the communication box comprises: an antenna including a flat surface extended in a direction that intersects the flat surface of the display panel; an antenna case in which the antenna is accommodated; and an inner plate inserted into the antenna case and positioned between the antenna and the antenna case” are indefinite, since (a) it’s unclear how merely a flat extended surface forms an antenna, and (b) how “an antenna including a flat surface”, “an antenna case” and “an inner plate” form a communication box. In other words, it’s not understood how a flat surface makes the box communicate. There is no transceiver, controller or feed structure recited in an interrelated manner for the “antenna” or “communication box” to be operable.
In view of the forementioned, scope of “a display device” cannot be ascertained.
Claims 2-15 are rejected for depending therefrom.
There should be a clear recitation of interrelated structure in order to provide a complete and operable display device.
The following claim, drafted by the examiner and considered to distinguish patentably over the art of record in this application, is presented to applicant for consideration:
1. (Amended) A display device comprising:
a display panel including a flat surface on which an image is displayed;
a frame to which the display panel is coupled;
a back cover coupled to the frame; and
a communication box adjacent to one side of the frame and coupled to the frame,
wherein the communication box comprises:
an antenna including a plurality of patches disposed on a substrate, the substrate having a flat surface extended in a direction that intersects the flat surface of the display panel, the plurality of patches having a respective feeding portion;
an antenna case in which the antenna is accommodated; and
an inner plate inserted into the antenna case and positioned between the antenna and the antenna case.
Allowable Subject Matter
Claims 10-14 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.

The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
