Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claims 1 and 6 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Kovesi et al. (US 2014/0072211).
With respect to claims 1 and 6, Kovesi discloses in figure 3 a motion sensor and a method thereof with self-adaptive adjustment function, comprising: a sensing module (342, e.g., a motion sensor) configured to generate a sensing signal (S1, e.g., a sensing signal); a processing module (335, e.g., a CPU or a processor) connected to the sensing module (see figure 3), and configured to calculate a duration of the sensing signal (paragraph 0008, e.g., “calculating a total change area … creating a list of occupancy candidate regions based on filtering of determined areas … tacking the one or more occupancy candidate regions over a period of time”); and a communication module (330, e.g., a communication interface or communication module) connected to the processing module (see figure 3); wherein when the processing module is in a preset state and the duration of the sensing signal is greater than or equal to a target threshold value (paragraph 0006, e.g., “… generate one or more centroids that represent areas of the occupancy candidate that are greater than a second threshold …”, the processing module is configured to generate a control signal (S2, e.g., a control signal) and transmit the control signal to a target device (310-320, e.g., a luminaire or a target device) via the communication module (see figure 3).
