Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
Claims 1 – 2 and 8 – 10 are rejected under 35 U.S.C. 112(a) as failing to comply with the written description requirement. The claims contain subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Specifically, at Lines 40 - 41 of Claim 1, the recitation “are jointly estimated through backpropagation method together with the periodic network module and the control network module” is not specifically supported by the Specification which states at original claim 1, at the last line of Page 4 through the first line of Page 5, and at Lines 6 – 7 of Page 14 that “other parts of the network are jointly estimated through backpropagation method” without a clear indication of what “other parts” or what “network”. Notice that Claims 2 and 8 – 10 fall rejected with Claim 1 due to dependency upon the limitations of Claim 1.
Response to Applicants Amendments and Arguments
Applicants amendments and arguments filed August 31, 2026 have been fully considered.
First, the Examiner agrees that the amendment to Claim 8 overcomes the Objection to Claim 8 as set forth and made of record in the Office Action mailed May 13, 2026.
Second, the Examiner agrees that - - [t]he deletion of “the synergy basis recruitment module maintains a synergy basis dictionary” is to avoid repetition - - (REMARKS, Page 6, Lines 5 – 6 (lines of page, not including blank lines or page headers) in Claim 1.
Third, the Examiner disagrees that “no new matter has been introduced by the amended claims” (REMARKS, Page 5, Lines 2 – 3 (Line reference made by all written lines, excluding blank lines, page headings, and section headings.)) for the reasoning set forth above.
