Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claims 1, 11 and 12, which recites “…under a grayscale level n;…” render the claim indefinite. Specifically, the claim as presented does not recite the value of variable “n”. Thus, under BRI the value of n can be negative and when the claim is interpreted to have a negative value for “n”, it is not clear how the image can have a negative grayscale, thus rendering the claim indefinite. Claims 2-10, 13-20 which depends upon claim 1 and 12 are also rejected for the same reasons as they require all the limitation of claims 1 and 12 (Note: Examiner contacted Attorney Charles Ho to discuss Examiner’s Amendment. However, no agreement was reached and Attorney indicated for formal Office action.).
Allowable Subject Matter
Claims 1-20 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Gao (2021/0407368) teaches a display device and an overdrive method thereof are provided. The overdrive method includes that in a frame picture, when a data signal of a data line needs to be switched from a grayscale of a previous row to a target grayscale of a current row, a feedback grayscale is looked up to be obtained according to a default feedback lookup table, the target grayscale of the current row, and an input grayscale of the previous row, a gain grayscale is looked up to be obtained according to a default gain lookup table and the feedback grayscale, and the gain grayscale is stored into a row buffer. Gao further teaches the display device further comprises an overdrive lookup table connected to the timing controller and a source driver connected to the timing controller and the display panel, wherein the overdrive lookup table is used to compare the target grayscale of the current row with the input grayscale of the previous row and to look up to obtain an overdrive grayscale (para [0036]).
Han et al. (2021/0225246) teaches a display method of a display panel, The display method may include obtaining original luminance of three single color subpixels in each of the pixel units based on an image to be displayed; obtaining luminance compensation values of the three single color subpixels that need to be color compensated at a time of obtaining the luminance of the mixed color subpixel as the first substitute luminance; calculating luminance of the mixed color produced by the three single color subpixels in the pixel unit respectively based on each of the luminance of the three single color subpixels after color compensation; and setting input luminance of the single color subpixel having the smallest luminance of the mixed color as 0, and obtaining actual luminance of the other single color subpixels and the mixed color subpixel.
Kimura (2015/0116376) teaches A display apparatus includes: a light emitting unit having a plurality of light sources; a display unit; a determination unit configured to determine, for each light source, a target brightness on the basis of a display image data in region corresponding to the light source; and a control unit configured to control the emission brightness of each light source to the target brightness, wherein when a brightness-insufficient light source is present, the determination unit adjusts the target brightness of light sources around the brightness-insufficient light source, to a value higher than a value corresponding to the display image data in regions corresponding to the light sources around the brightness-insufficient light source.
Fu et al. (2024/0105136) teaches An electronic device includes a display unit, a voltage generation unit, a grayscale adjustment unit, and an overdriving unit. The display unit has a relationship curve between the transmittance and the driving voltage. The relationship curve has a predetermined voltage value corresponding to the maximum transmittance. The voltage generation unit generates a first voltage according to a first grayscale, and generates a second voltage according to a second grayscale. The grayscale adjustment unit receives a first display grayscale value, and outputs the second grayscale value when the first display grayscale value is equal to the first grayscale. The overdriving unit overdrives the second voltage corresponding to the second grayscale to obtain a first target driving voltage, and it provides the first target driving voltage to the display unit.
Kim et al. (2024/0135851) A luminance compensation method for a display device includes measuring a luminance of each of white grayscale values, measuring an actual luminance value for each of colors, determining a target luminance value for each of the colors based on the luminance of each of the white grayscale values and a luminance contribution ratio of each of the colors, determining a luminance compensation amount for each of the colors based on the target luminance value and the actual luminance value, and compensating for input image data for each of the colors based on the luminance compensation amount.
