Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg , 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman , 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi , 759 F.2d 887, 225 USPQ 645 (Fed. A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. The display substrate according to claim 13, wherein the circuit structure layer comprises: a semiconductor layer, a first insulation layer, a first conductive layer, a second insulation layer, a second conductive layer, a third insulation layer, and a third conductive layer which are sequentially stacked on the base substrate; the semiconductor layer comprises: active layers of all transistors located in the light emitting drive circuit; the first conductive layer comprises: control electrodes of all transistors and a first electrode plate of a first capacitor to a first electrode plate of a third capacito r located in the light emitting drive circuit; the second conductive layer comprises a second electrode plate of the first capacitor to a second electrode plate of the third capacitor located in the light emitting drive circuit; the third conductive layer comprises an initial signal line, a first clock signal line, a second clock signal line, a first power supply line , and a second power supply line. 15. The display substrate according to claim 14, wherein the shift register comprises: a first transistor to a fourteenth transistor ; in a plane where the display substrate is located, in the first direction, all transistors and capacitors are located between the third power supply line and the second power supply line, a second capacitor is located between the third power supply line and an eighth transistor, the eighth transistor is located between the second capacitor and a ninth transistor and a tenth transistor, the ninth transistor and the tenth transistor are located between the eighth transistor and, an eleventh transistor and a twelfth transistor, the eleventh transistor and the twelfth transistor are located between the ninth transistor and the tenth transistor and a thirteenth transistor and the fourteenth transistor, and the thirteenth transistor and the fourteenth transistor are located between the eleventh transistor and the twelfth transistor and the second power supply line; in the second direction, the third capacitor, the ninth transistor, the tenth transistor, and the first capacitor are sequentially arranged along the second direction, the twelfth transistor and the eleventh transistor are sequentially arranged along the second direction, and the fourteenth transistor and the thirteenth transistor are sequentially arranged along the second direction. 9. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. Claims 1-20 are rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which a joint inventor regards as the invention. Regarding Claims 1 and 9. Claims 1 and 12 contains several limitations, similar to the following examples: “configured to provide a signal of the signal input terminal to the first node under control of the first clock signal terminal , the second clock signal terminal, the second node, and the first power supply terminal and maintain a potential of the first node”, “configured to provide a signal of the second clock signal terminal or the first power supply terminal to the fourth node under control of the second clock signal terminal , the first node, and the second node and maintain a potential of the fourth node” The broadest reasonable interpretation (BRI) of the cited limitations is a passive circuit component actively controlling an input signal to achieve a claimed result. Control of the input signal is actually performed by varying a signal present on the passive circuit component. Claims 1 and 9 are indefinite because they contain limitations that do not accurately represent how the claimed circuit function is performed and can be reasonably interpreted as (1) passive circuit components performing an active control function and as (2) an active component at the location of the passive component performs an active control function. Regarding Claims 2-8, and 10-20 . Claims 2-8, and 10-20 are rejected under 35 USC §112(b) for containing the indefinite subject matter of their respective parent claim. In support of compact prosecution the limitations containing “under control of a [passive element]” are construed “under control of signals from the [passive element]”. Allowable Subject Matter Claims 1 and 9 would be allowable if rewritten or amended to overcome the rejection under 35 U.S.C. 112(b) set forth in this Office action. 07-43-02 Claims 2-8, and 10-20 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. 13-03-01 AIA The following is a statement of reasons for the indication of allowable subject matter: Claim 1 contains the following subject matter that is neither taught nor suggested by the prior art, either alone or in combination: a shift register, wherein the second output sub-circuit is connected with the first signal output terminal, the third control sub-circuit, the first power supply terminal, the second power supply terminal, and a second signal output terminal, respectively and is configured to provide a signal of the first power supply terminal or the second power supply terminal to the second signal output terminal under control of signals from the third control sub-circuit and the first signal output terminal.
