DETAILED ACTION It would be of great assistance to the Office if all incoming papers pertaining to a filed application carried the following items: 1. Application number (checked for accuracy, including series code and serial no.). 2. Group art unit number (copied from most recent Office communication). 3. Filing date. 4. Name of the examiner who prepared the most recent Office action. 5. Title of invention. 6. Confirmation number (See MPEP § 503). Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings The drawings are objected to as failing to comply with 37 CFR 1.84(p)(5) because they do not include the following reference sign(s) mentioned in the description: S1301-S1302. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the a preset backlight interval, [wherein] a minimum value of the preset backlight interval is a minimum backlight value that is allowed to be adjusted to when backlight adjustment is performed through direct current DC dimming, and a maximum value of the preset backlight interval is a maximum backlight value that is allowed to be adjusted to when backlight adjustment is implemented through PWM dimming must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. The USPTO “Interim Guidelines for Examination of Patent Applications for Patent Subject Matter Eligibility” (Official Gazette notice of 22 November 2005), Annex IV, reads as follows (see also MPEP 2106): Descriptive material can be characterized as either "functional descriptive material" or "nonfunctional descriptive material." In this context, "functional descriptive material" consists of data structures and computer programs which impart functionality when employed as a computer component. (The definition of "data structure" is "a physical or logical relationship among data elements, designed to support specific data manipulation functions." The New IEEE Standard Dictionary of Electrical and Electronics Terms 308 (5th ed. 1993).) "Nonfunctional descriptive material" includes but is not limited to music, literary works and a compilation or mere arrangement of data. When functional descriptive material is recorded on some computer-readable medium it becomes structurally and functionally interrelated to the medium and will be statutory in most cases since use of technology permits the function of the descriptive material to be realized. Compare In re Lowry, 32 F.3d 1579, 1583-84, 32 USPQ2d 1031, 1035 (Fed. Cir. 1994) (claim to data structure stored on a computer readable medium that increases computer efficiency held statutory) and Warmerdam, 33 F.3d at 1360-61, 31 USPQ2d at 1759 (claim to computer having a specific data structure stored in memory held statutory product-by-process claim) with Warmerdam, 33 F.3d at 1361, 31 USPQ2d at 1760 (claim to a data structure per se held nonstatutory). In contrast, a claimed computer-readable medium encoded with a computer program is a computer element which defines structural and functional interrelationships between the computer program and the rest of the computer which permit the computer program's functionality to be realized, and is thus statutory. See Lowry, 32 F.3d at 1583-84, 32 USPQ2d at 1035. Official Gazette Notice 1351 OG 212 February 23, 2010 Subject Matter Eligibility of Computer Readable Media - The United States Patent and Trademark Office (USPTO) is obliged to give claims their broadest reasonable interpretation consistent with the specification during proceedings before the USPTO. See In re Zletz, 893 F.2d 319 (Fed. Cir. 1989) (during patent examination the pending claims must be interpreted as broadly as their terms reasonably allow). The broadest reasonable interpretation of a claim drawn to a computer readable medium (also called machine readable medium and other such variations) typically covers forms of non-transitory tangible media and transitory propagating signals per se in view of the ordinary and customary meaning of computer readable media, particularly when the specification is silent. See MPEP 2111.01. When the broadest reasonable interpretation of a claim covers a signal per se, the claim must be rejected under 35 U.S.C. § 101 as covering non-statutory subject matter. See In re Nuijten, 500 F.3d 1346, 1356-57 (Fed. Cir. 2007) (transitory embodiments are not directed to statutory subject matter) and Interim Examination Instructions for Evaluating Subject Matter Eligibility Under 35 U.S.C. § 101, Aug. 24,2009; p. 2. The USPTO recognizes that applicants may have claims directed to computer readable media that cover signals per se, which the USPTO must reject under 35 U.S.C. § 101 as covering both non-statutory subject matter and statutory subject matter. In an effort to assist the patent community in overcoming a rejection or potential rejection under 35 U.S.C. § 101 in this situation, the USPTO suggests the following approach. A claim drawn to such a computer readable medium that covers both transitory and non-transitory embodiments may be amended to narrow the claim to cover only statutory embodiments to avoid a rejection under 35 U.S.C. § 101 by adding the limitation "non-transitory" to the claim. Cf. Animals - Patentability, 1077 Off. Gaz. Pat. Office 24 (April 21, 1987) (suggesting that applicants add the limitation "non-human" to a claim covering a multi-cellular organism to avoid a rejection under 35 U.S.C. § 101). Such an amendment would typically not raise the issue of new matter, even when the specification is silent because the broadest reasonable interpretation relies on the ordinary and customary meaning that includes signals per se. The limited situations in which such an amendment could raise issues of new matter occur, for example, when the specification does not support a non-transitory embodiment because a signal per se is the only viable embodiment such that the amended claim is impermissibly broadened beyond the supporting disclosure. See, e.g., Gentry Gallery, Inc. v. Berkline Corp., 134 F.3d 1473 (Fed. Cir. 1998). Claim 15 is rejected under 35 U.S.C. 101 because the claimed invention is directed to non-statutory subject matter as follows. Claim 15 defines a “computer-readable storage medium”. The broadest reasonable interpretation of one of ordinary skill in the art would understand a computer readable medium to encompass both physical and transitory mediums, and therefore, the claim limitation as recited is considered non-statutory. The Examiner suggests amending the claim to read “A non-transitory computer readable…”. Claims 16 – 20 are rejected based on their dependence on claim 15. Allowable Subject Matter Claims 1 – 14 are allowed. The following is an examiner’s statement of reasons for allowance: As to claim 1, The Prior Art of record fails to disclose a backlight adjustment method, applied to a terminal device, wherein the method comprises: displaying an nth image frame, wherein when the nth image frame is displayed, a backlight value of the terminal device is a first backlight value, and a pulse quantity within a unit time in a pulse width modulation (PWM) signal used by the terminal device for backlight adjustment is a first pulse quantity; and displaying an (n+1)th image frame, wherein when the (n+1)th image frame is displayed, a backlight value of the terminal device is a second backlight value, and a pulse quantity within a unit time in a PWM signal used by the terminal device for backlight adjustment is a second pulse quantity; and the second pulse quantity is less than the first pulse quantity, the second backlight value is not equal to the first backlight value, the second backlight value belongs to a preset backlight interval, a minimum value of the preset backlight interval is a minimum backlight value that is allowed to be adjusted to when backlight adjustment is performed through direct current DC dimming, and a maximum value of the preset backlight interval is a maximum backlight value that is allowed to be adjusted to when backlight adjustment is implemented through PWM dimming. (Emphasis Added.) As to claim 8, The Prior Art of record fails to disclose a terminal device, comprising: a processor; and a display unit configured to: display an nth image frame, wherein when the nth image frame is displayed, a backlight value of a terminal device is a first backlight value, and a pulse quantity within a unit time in a pulse width modulation (PWM) signal used by the terminal device for backlight adjustment is a first pulse quantity, and display an (n+1)th image frame, wherein when the (n+1)th image frame is displayed, a backlight value of the terminal device is a second backlight value, and a pulse quantity within a unit time in a PWM signal used by the terminal device for backlight adjustment is a second pulse quantity, wherein the second pulse quantity is less than the first pulse quantity, the second backlight value is not equal to the first backlight value, the second backlight value belongs to a preset backlight interval, a minimum value of the preset backlight interval is a minimum backlight value that is allowed to be adjusted when backlight adjustment is performed through direct current (DC) dimming, and a maximum value of the preset backlight interval is a maximum backlight value that is allowed to be adjusted when backlight adjustment is implemented through PWM dimming. (Emphasis Added.)
