Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Priority Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Information Disclosure Statement The information disclosure statement (IDS) submitted on 12/4/2025 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Drawings The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the “the second antenna comprising at least one second set of turns comprising at least one turn, called internal turn, surrounding the chip” must be shown or the feature(s) canceled from the claim(s) (Figures appear to illustrate at least one internal turn of the second antenna surrounds the passive electronic element in some figures (e.g. Figs. 4 and 6), and surrounds the opening 112 in Figs. 5 and 7, but there does not appear to be a Figure where at least one internal turn of the second antenna surrounds the chip). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Objections Claims 1, 2 and 12 are objected to because of the following informalities: Claim 1 recites “at least one turn, called external turn, following the perimeter” and “at least one turn, called internal turn, surrounding the chip”. Suggested language is “at least on external turn that follows the perimeter” and “at least one internal turn that surrounds the chip”. Claim 2 recites “at least one from among”. Suggested language is “at least one of”. Claims 12 contains acronyms, however does not provide the full names. If the applicant is to claim the acronyms, the full names should be referenced at least once within the claims in parentheses (e.g. light-emitting diode (LED)). Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 1-20 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Claim 1 recites “the second antenna comprising at least one second set of turns comprising at least one turn, called internal turn, surrounding the chip”. While this is recited in the specification, the specification does not appear to clearly describe how both the internal turns of the first antenna and the second antenna surround the chip. For example, the specification describes that the chip is on the first antenna layer 120 (pg. 10, line 32) and the second antenna being on a second antenna layer 130 where a passive electronic component is mounted (pg. 11, line 20). The specification additionally discloses the second antenna includes a set of turns that encircle opening 112 with at least one turn 135 (pg. 11, lines 8-10). However, the specification does not appear to describe turns of the second antenna encircle/surround the chip of the first antenna layer. Therefore, the specification does not appear to teach a working embodiment of how turns of the second antenna of a second antenna layer surrounds the chip of the first antenna layer. Claims not specifically addressed fail to comply with the written description requirement due to their dependency. The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 recites “the second antenna comprising at least one second set of turns comprising at least one turn, called internal turn, surrounding the chip”. However, the claim additionally recites “the first antenna comprising at least one second set of turns comprising at least one turn, called internal turn, surrounding the chip” and “the second set of turns of the second antenna being disposed opposite the second set of turns of the first antenna”. It is not clear how the internal turn of both the first and the second antenna, which are disposed opposite of each other, both surround the chip. Please clarify. Claims 9 and 19 recite “at least one second slot”. However the claims fail to recite a first slot. Therefore, it is not clear if the applicant intends there to be two slots or one slot. Please clarify. For examination purposes, the claim language will be interpreted as one slot and “second” is merely a title. Claims not specifically addressed are indefinite due to their dependency. Examiner’s Remarks With respect to claim(s) 1-20, the examiner makes no prior art rejection. However, these claims are not allowable pursuant to the 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, rejection and 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, rejection.
