Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Drawings
The drawings are objected to because the bases of claim 2, the feather cap slides over at least a portion of the hub of claim 3, the drive shaft protruding through the feather cap of claim 4, the drive shaft of the hub does not protrude entirely through the finger plate of claim 5, the drive shaft is flush with an outer surface of the finger plate of claim 6, the finger plate is bolted to the drive shaft of claim 7, the rubber fingers are held in place by compression of claim 8, the thickness of the feather cap of claims 10 and 11, the drive shaft opening is square or triangular of claim 12, and an adapter used to physically couple the feather cap and the drive shaft of claim 14, must be shown or the feature(s) canceled from the claim(s). Additionally, the drawings fail to show a cross sectional drawing showing the various elements working together and the Applicant has failed to use the appropriate reference numeral arrows designating the particular element denoted by the reference numerals as described in the specification. The three protrusions, the thickness of the feather cap, drive shaft, center opening of the finger plate, holes in the feather cap, a larger hub opening, drive shaft that is flus or partially flush and the two circular elements denoted by a dashed line have no reference numerals. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
The drawings are objected to under 37 CFR 1.83(b) because they are incomplete. 37 CFR 1.83(b) reads as follows:
When the invention consists of an improvement on an old machine the drawing must when possible exhibit, in one or more views, the improved portion itself, disconnected from the old structure, and also in another view, so much only of the old structure as will suffice to show the connection of the invention therewith.
Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. New corrected drawings in compliance with 37 CFR 1.121(d) are required in this application because the above listed deficiencies. Applicant is advised to employ the services of a competent patent draftsperson outside the Office, as the U.S. Patent and Trademark Office no longer prepares new drawings. The corrected drawings are required in reply to the Office action to avoid abandonment of the application. The requirement for corrected drawings will not be held in abeyance.
Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claims 1-14 are rejected under 35 U.S.C. 101 because the disclosed invention is in operative and therefore lacks utilty. In light of the objections to the drawings listed above, and review of paragraphs 0033-0037 of the detailed specification, the Examiner does not understand the following, 1. How the drive shaft interacts with the other elements of the poultry defeathering device, 2. How the finger plate 120 is joined, anc connected and/or coupled by the bolt, 3. The feather cap having a larger hub opening to receive hub 150, 4. The feather cap coupled to the hub using one or more screws disposed through the feather cap,
