Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Kelleher et al. (2019/0353245).
Regarding claim 1, Kelleher discloses a power tool comprising: a motor (205) having a drive shaft (210); a transmission having an input shaft (260) operatively coupled to the drive shaft of the motor and an output shaft (270; Fig. 2B) operatively coupled to a tool holder (Fig. 2A); wherein the transmission comprises at least a first gear (230) and a second gear (250) configured to transmit torque from the motor to the tool holder (Fig. 2A), and a gear selection key (280) moveable between a first position (Fig. 2C) and a second position (Fig. 2D) and configured to engage the first gear to the output shaft in the first position such that the torque is transmitted from the motor to the tool holder via the first gear (Fig. 2C) and configured to engage the second gear to the output shaft in the second position such that the torque is transmitted from the motor to the tool holder via the second gear (Fig. 2D); wherein the first position and the second position are separated by a distance (i.e. width of 275; Fig. 2B) greater than a width of the gear selection key (280; as shown in Fig. 2B).
