Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-15 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Weikard et al. (USPGPub 2018/0320019).
Regarding claims 1 and 13-15, Weikard teaches that it is known to provide a single layer of polyurethane [0028] coated on the surface of a plastic substrate [0115] wherein the layer is thereafter cured by providing a polyisocyanate, an NCO-reactive compound and a thermally latent catalyst (claim 1).
Regarding claim 2, Weikard teaches wherein the plastic substrate by be ABS [0115].
Regarding claim 3, Weikard further teaches wherein the polyisocyanate is aliphatic [0050].
Regarding claim 4, Weikard further teaches wherein the polyisocyanate is a derivative of hexamethylene diisocyanate.
Regarding claim 5, Weikard further teaches wherein the polyisocyanate is a hexamethylene diisocyanate trimer.
Regarding claim 6, Weikard further teaches wherein the NCO reactive compound is among those listed [0123].
Regarding claim 7, Weikard further teaches wherein the thermally latent catalyst is among those listed (claim 8).
Regarding claim 8, Weikard further teaches wherein the catalyst is among those claimed [0096-0110].
Regarding claim 9, Weikard teaches ppm of catalyst is in range claimed [0143].
Regarding claim 10, Weikard teaches a ratio of polyisocyanates to NCO reactive compounds is within the range claimed [0053].
Regarding claim 11, Weikard further teaches a film forming step lasting 30 seconds as claimed (claim 1).
Regarding claim 12, Weikard further teaches wherein the reaction takes places at a temperature in the claimed range [0127].
