Office Action

§112
DETAILED ACTION The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The status of the claims for this application is as follows. Claims 1-20 are currently pending. Information Disclosure Statement The information disclosure statement (IDS) submitted on 10/03/2025 was considered by the examiner. Drawings The drawings were received on 10/03/2025. The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the “wherein a machine-readable code, in particular a QR code, is preferably depicted on at least one of the signal surfaces” (claim 15) must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Interpretation The following is a quotation of 35 U.S.C. 112(f): (f) Element in Claim for a Combination. – An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The following is a quotation of pre-AIA 35 U.S.C. 112, sixth paragraph: An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. This application includes one or more claim limitations that do not use the word “means,” but are nonetheless being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, because the claim limitation(s) uses a generic placeholder that is coupled with functional language without reciting sufficient structure to perform the recited function and the generic placeholder is not preceded by a structural modifier. Such claim limitation(s) is/are as followed: Claim 1: the limitation "locking element" invokes 112(f) because: (A) the claim limitation uses the generic placeholder "element"; (B) the generic placeholder "element" is modified by functional language e.g., "locking"; and (C) the generic placeholder "element" is not modified by sufficient structure, material, or acts for performing the claimed function. The disclosed associated structure is a rod (represented by applicant’s element 12 in the drawing(s) and in the specification). As such, the recitation "locking element" will be interpreted as being a rod and any structural/functional equivalents. Claim 1: the limitation "guiding device" invokes 112(f) because: (A) the claim limitation uses the generic placeholder "device"; (B) the generic placeholder "device" is modified by functional language e.g., "guiding"; and (C) the generic placeholder "device" is not modified by sufficient structure, material, or acts for performing the claimed function. The disclosed associated structure is a slot having a curved/arched path (represented by applicant’s element 14 which comprises 14a, 14b, 14_1, and 14_2 in the drawing(s) and in the specification). As such, the recitation "guiding device" will be interpreted as being a slot having a curved/arched path. Because this/these claim limitation(s) is/are being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, it/they is/are being interpreted to cover the corresponding structure described in the specification as performing the claimed function, and equivalents thereof. If applicant does not intend to have this/these limitation(s) interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph, applicant may: (1) amend the claim limitation(s) to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph (e.g., by reciting sufficient structure to perform the claimed function); or (2) present a sufficient showing that the claim limitation(s) recite(s) sufficient structure to perform the claimed function so as to avoid it/them being interpreted under 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 2, 4-7, 10, 12, 15-18, and 20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claims 2, 4, 7, 10, 12, 15, 16, and 20, the phrase "preferably" renders the claim indefinite because it is unclear whether the limitations following the phrase are part of the claimed invention. See MPEP § 2173. Regarding claims 4 and 7, the phrase "particularly preferably" renders the claim indefinite because it is unclear whether the limitations following the phrase are part of the claimed invention. See MPEP § 2173. Regarding claim 4, the phrase "preferably substantially" renders the claim indefinite because it is unclear whether the limitations following the phrase are part of the claimed invention. See MPEP § 2173. A broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) may be considered indefinite if the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. See MPEP § 2173.05(c). In the present instance, claim 4 recites “wherein the central portion (6c) is in contact with the outer circumferential surface (UA4) of the inner sleeve (4) at least in portions and preferably extends in the circumferential direction over an angle of at least 30°, preferably at least 45°, particularly preferably at least 60°, in particular at least 90°”. The claim(s) are considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims. A broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) may be considered indefinite if the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. See MPEP § 2173.05(c). In the present instance, claim 7 recites “wherein the locking recess (11) is configured as a circumferential groove and extends in the circumferential direction of the inner sleeve (4) over a groove angle (a) of at least 30°, preferably at least 60°, particularly preferably at least 90°, wherein the circumferential groove preferably lies in a plane which is perpendicular to the longitudinal axis of the inner sleeve (4).”. The claim(s) are considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims. Allowable Subject Matter Claims 1, 3, 8, 9, 11, 13, 14, and 19 are allowed. Claims 2, 4-7, 10, 12, 15-18, and 20 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Claim 15 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Reasons for Allowance The following is an examiner’s statement of reasons for allowance: The prior art of record does not anticipate all the limitations as recited in independent claims 1 and 19. The prior art does not provide any teaching, suggestion or motivation (TSM) to modify the prior art as such. There is no cogent reasoning that is unequivocally independent of hindsight that would have led one of ordinary skill in the art at the time the invention was made to modify the prior art to obtain the applicant’s invention. Even though, the individual parts are known per se, there is nothing to teach the specific structures and structural combinations as claimed. More specifically, it is the totality of that which is claimed that is not found in the rt of record. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The following documents have structural features which are similar to the applicant’s claimed invention; DE-202011052283-U1, DE-855833-C, FR-2669709-A1, WO-2007057068-A1, US-20090008927-A1, and US-20180339562-A1.
