CLAIMS 1-11 AND 21-29 ARE PRESENTED FOR EXAMINATION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Applicant’s amendment, terminal disclaimers, remarks and Information Disclosure Statement filed August 13, 2026 have been received and entered into the application. As reflected by the attached, completed copies of form PTO/SB/08, the cited references have been considered by the Examiner. Also, the application papers have been amended as directed.
The previous rejection of the claims under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite has been overcome by Applicant’s amendment.
The U.S. Patent Applications and U.S. Patent which served as basis for double patenting rejections in the previous Office action are no longer listed below as they have been effectively removed by the terminal disclaimers presently filed by Applicant.
Double Patenting
Claims 1-11 and 21-29 are rejected on the ground of nonstatutory double patenting as being unpatentable over claims 1-11 and 21-29 of now allowed U.S. Patent Application Nos. 19/568,540 or 19/428,043 or claims 1-11 and 21-29 of now allowed U.S. Patent Application No. 19/428,098 in view of Sinha, (U.S. 2024/0474594, and Jordan, (U.S. Patent No. 6,448,323) OR claims 1-11 and 21-29 are provisionally rejected on the grounds of nonstatutory double patenting as being unpatentable over claims 1-20 of U.S. Patent Application Nos. 19/420,555, 19/442,974, 19/533,028, 19/540,478 or 19/561,256 or over claims 1-11 and 21-29 of U.S. Patent Application No. 19/412,714 or over claims 1-11, 17-19 and 21-26 of U.S. Patent Application No. 19/546,276, newly cited, for the reasons of record as set forth in the previous Office action pertaining to the claims both provisionally rejected or non-provisionally rejected for double patenting, which reasons are here incorporated by reference.
Applicant’s remarks and terminal disclaimer have been considered, but are not persuasive of error here because the above patent applications are being newly cited and thus were not included on Applicant’s terminal disclaimer.
Thus, the claims are deemed properly rejected and none of the claims are currently in condition for allowance.
