DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Priority
Applicant’s claim for the benefit of a prior-filed application under 35 U.S.C. 119(e) or under 35 U.S.C. 120, 121, 365(c), or 386(c) is acknowledged. Applicant has not complied with one or more conditions for receiving the benefit of an earlier filing date under 35 U.S.C. 120 as follows:
The later-filed application must be an application for a patent for an invention which is also disclosed in the prior application (the parent or original nonprovisional application or provisional application). The disclosure of the invention in the parent application and in the later-filed application must be sufficient to comply with the requirements of 35 U.S.C. 112(a) or the first paragraph of pre-AIA 35 U.S.C. 112, except for the best mode requirement. See Transco Products, Inc. v. Performance Contracting, Inc., 38 F.3d 551, 32 USPQ2d 1077 (Fed. Cir. 1994).
The disclosure of the prior-filed application, Application No. 19240600, fails to provide adequate support or enablement in the manner provided by 35 U.S.C. 112(a) or pre-AIA 35 U.S.C. 112, first paragraph for one or more claims of this application. The prior-filed application fails to provide adequate support for at least the following: 1) a graphical control that is collapsible; 2) the graphical controls for reservoir boundary picking comprise an artificial intelligence (AI) selector for selecting an AI technology from a number of AI technologies to perform the reservoir boundary picking; and 3) responsive to selection of a different one of the number of AI technologies, automatically re-performing the reservoir boundary picking to re-generate at least one of the one or more of the reservoir boundaries. Accordingly, claims 2 and 4-7 are not entitled to the benefit of the prior application.
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claim 2 is rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, because the specification, while being enabling for an expandible graphical control, does not reasonably provide enablement for a collapsible graphical control. The specification does not enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and/or use the invention commensurate in scope with these claims. Paragraphs 0149 and 0150 of the specification refer to a graphical control that is expandible and compressed/contracted. But the word “collapsible” cannot be found anywhere in the specification.
Claims 4-7 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, because the specification, while being enabling for using a GUI to pick boundaries, which may be controlled by AI (see paragraphs 00133-00138, 00149, and 00227), does not reasonably provide enablement for an artificial intelligence (AI) selector for selecting an AI technology from a number of AI technologies to perform the reservoir boundary picking. The specification does not enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and/or use the invention commensurate in scope with these claims. The specification is devoid of a reference to an artificial intelligence (AI) selector for selecting an AI technology from a number of AI technologies. The specification is also devoid of a reference to automatically re-performing the reservoir boundary picking to re-generate at least one of the one or more of the reservoir boundaries, as in claim 7.
Allowable Subject Matter
Claims 1, 3, and 8-20 are allowed.
The following is a statement of reasons for the indication of allowable subject matter:
US 20190271788 teaches a method relating to the control of wellbore trajectory, while also using quality control for various forms of data and a graphic user interface (paragraphs 0045 and 0074). However, it is not reasonably taught or suggested that there is a quality control actuator for quality control of reservoir boundary picking via user interaction with respect to a rendering of one or more reservoir boundaries, a quality control actuator for quality control of reservoir boundary extrapolation of the reservoir boundaries via user interaction with respect to a rendering of at least one or more of the reservoir boundaries, or a quality control actuator for quality control of target selection via user interaction with respect to a rendering of at least one or more extrapolated reservoir boundaries.
US 20230039147 teaches a method relating to the control of wellbore trajectory, while also using quality control for various forms of data and a graphic user interface (paragraphs 0386-0388).
The other cited prior art of record, whether considered alone or in combination, fails to overcome the deficiencies above.
Conclusion
The prior art made of record on form 892 and not relied upon is considered pertinent to applicant's disclosure.
