Office Action

§112
DETAILED ACTION This application is a reissue of D850,528 and a division of reissue application 29/856,963. A determination regarding whether this application complies with 35 U.S.C. 251 is not possible until the issue stated in the below rejection has been addressed. Specification The information in the “Cross reference to related applications statement” is incorrect. The information incorrectly states that this application is a reissue of D580,528. The correct patent number is D850,528. Claim Rejections - 35 USC § 112 The claim is rejected under 35 U.S.C. 112, (a) and (b), as the claimed invention is not described in such full, clear, concise and exact terms as to enable any person skilled in the art to make and use the same, and fails to particularly point out and distinctly claim the subject matter which applicant regards as the invention. PNG media_image1.png 370 657 media_image1.png Greyscale PNG media_image2.png 224 400 media_image2.png Greyscale The claim is indefinite and nonenabling because the drawing disclosure fails to convey the scope of the design in clear terms. The perimeter of the top surface is the only aspect of the design that is delineated by solid lines. The edges throughout the front, rear and side surface are all shown as broken lines. As a result, while the surface shading indicates that the front and rear surfaces are claimed, the broken line edges corresponding to these surfaces in the side views describe unclaimed matter. Similarly, which the surface shading indicates that the side surfaces are claimed, the broken line edges in the front and rear views describe the sides as unclaimed matter. Simply put, the extensive use of broken line edges creates an inconsistent and confusion description of the claimed design. Therefore, it is unclear what aspects of the design the applicant regards as the claimed design. PNG media_image3.png 218 651 media_image3.png Greyscale Drawings A shade line should be added along the bottom edge of the body in the front, rear and side views, to describe the inwardly contouring form. PNG media_image4.png 218 490 media_image4.png Greyscale Conclusion The claim is rejected under 35 U.S.C. § 112, (a) and (b). Any inquiry concerning this communication should be directed to PHILIP S. HYDER at telephone number (571)272-2621. Examiner interviews are available via telephone, in-person, and video conferencing using a USPTO supplied web-based collaboration tool. To schedule an interview, applicant is encouraged to contact the examiner directly or use the USPTO Automated Interview Request (AIR) at http://www.uspto.gov/interviewpractice. If attempts to reach the examiner by telephone are unsuccessful, the examiner’s supervisor, Susan Krakower can be reached on 571-272-4496. /Philip S.
