DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on March 4, 2026 has been entered. Drawings The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the groove comprising a v-shape and inclined walls in claim 21 must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claim 21 is rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Claim 21 recites the limitation “the groove comprises a v-shape, having inclined walls” in the amendment to the claims. Paragraphs 0045-0046 of the specification describe the function of the groove, but does not specifically disclose that the groove comprises a v-shape or that it has inclined walls. The drawings also do not show a v-shape or inclined walls. Therefore, the claim introduces new matter into the claims since it contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim 21 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Miller et al (US 20080281341). Regarding claim 21, Miller discloses a device comprising: a storage inserter (56) configured for storing and inserting a corneal graft, wherein the storage inserter (56) comprises a distal tip configured for insertion into an eye of a patient (reduced distal end 56, figures 6A-6E); a proximal tray (See image above) that is wider than the distal tip, wherein the proximal tray is positioned proximally to the distal tip (figures 6A-6E), and a groove (groove defined between distal ends of 130), wherein the groove runs down a center of the distal tip and the proximal tray (paragraph 0059), wherein the groove is sized and configured to accommodate microforceps (can accommodate arbitrary microforceps), wherein the groove comprises a v-shape, having inclined walls (see image below), and wherein the groove is configured such that fluid can flow between the distal tip and the proximal tray (a fluid is capable of flowing between the distal tip and the proximal tray. It is noted that neither the fluid or microforceps are positively recited, therefore, as long as the prior art is capable of performing the recited functions, the prior art meets the limitations). The following is a statement of reasons for the indication of allowable subject matter: The claims are allowable over the body of prior art because the prior art (see previous Office Action), wherein the proximal tray having a length at least equal to the length of the distal tip comprises a flat loading platform having a proximal end, however, the prior art does not teach the combination of the remaining limitations in claim 1 with a proximal end of the platform defining a proximal edge comprising an angled scoop for scooping the corneal graft from a donor cornea, since there is no teaching, motivation or suggestion to produce the combined limitations set forth in claims 1 and 15.
