DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Information Disclosure Statement
The information disclosure statement (IDS) submitted on 07/23/2026 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-3, 5 and 7-10 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites the limitation “the polarization element comprises a photonic structure configured to couple the radiation perpendicularly out of an emission surface of the µ-LED arrangement and to deflect, laterally, an unconverted light that includes a second portion of the source light that has not been converted by the layer of the converter material”, which is inconsistent with the specification and figures. Applicant elected Species II of Fig. 33. Fig. 33 shows the interface between the layer of the converter material 7 and the polarization element 4 as the light-emitting surface 3. Thus, “the radiation” as clamed is the radiation exiting the layer of the converter material 7 and entering the polarization element 4, according to “emit radiation via a light-emitting surface” recited in the first two lines of claim 1. Thus, the radiation includes an unconverted light 8 and a converted light 9 according to pages 112-113 of the specification, while only the converted light 9 is “perpendicularly out of an emission surface of the µ-LED arrangement”, which is inconsistent with the limitation stated above. The inconsistency renders the claim indefinite.
Claims 2-3, 5 and 7-10 are rejected because they depend on the rejected clam 1.
Response to Arguments
Applicant’s amendments, filed 07/07/2026, partially overcome the rejections to claims 1-3, 5 and 7-10 under 35 U.S.C. 112. The rejections to claims 1-3, 5 and 7-10 under 35 U.S.C. 112 have been partially withdrawn. Please see the rejections above for details.
Applicant's arguments with respect to claim 1 have been considered but are moot in view of the new ground(s) of rejection.
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Fattal et al. (US 7808005 B1) teach a light-emitting device having a photonic grating configured to extract spontaneous emission of electromagnetic radiation from a light-emitting structure.
Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a).
A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
