Office Action

§102 §112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 03/27/2026 has been entered. Claim Rejections - 35 USC § 112 Claim 19 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 19 recites the limitation "a first sub connection electrode" in the third line of the claim. It is unclear whether this limitation is the same as or different from the limitation “a first sub connection electrode” recited in the third last and the second last line of claim 15. To expedite the examination, the two limitations are interpreted as referring to different elements. Claim 19 recites the limitation "a second sub connection electrode" in the sixth line of the claim. It is unclear whether this limitation is the same as or different from the limitation “a second sub connection electrode” recited in the second last line of claim 15. To expedite the examination, the two limitations are interpreted as referring to different elements. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 15-20 is/are rejected under 35 U.S.C. 102a(1)/a(2) as being anticipated by Chang (US 2020/0219858 A1). Allowable Subject Matter Claims 1-14 are allowed. The following is a statement of reasons for the indication of allowable subject matter: The prior art of record does not teach or suggest, singularly or in combination, at least the limitations of "wherein the connection electrode includes a first sub connection electrode disposed on opposing side surfaces of the first sub light emitting element and a second sub connection electrode disposed on opposing side surfaces of the second sub light emitting element, and wherein the first sub connection electrode is spaced apart from the second sub connection electrode" as recited in claim 1. Response to Arguments Applicant’s amendments, filed 03/27/2026, overcome the rejections to claims 15-20 under 35 U.S.C. 112. The rejections to claims 15-20 under 35 U.S.C. 112 have been withdrawn. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure.
