The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Acknowledgement is made of application #17/799,280 filed on 02/02/2023 in which claims 1-20 have been presented for prosecution in a first action on the merits.
Response to Amendment
Acknowledgement is made of preliminary amendment filed on 02/02/2023 in which claims 5-7,10,15,17 and 19 are currently amended. By this amendment, claims 1-20 are still pending in the application.
Priority
Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55.
Information Disclosure Statement
The information disclosure statements (IDS) submitted on 11/14/2022, 08/30/2024 and 04/23/2025 are in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statements are being considered by the examiner and placed of record. Initialed copies are attached herewith.
Drawings
The drawings are objected to under 37 CFR 1.83(a). The drawings must show every feature of the invention specified in the claims. Therefore, the underlined limitations of, “A charging compartment, configured such that a battery pack is placed by a battery pack transfer device, wherein the charging compartment comprises: a carrying mechanism, the carrying mechanism carries the battery pack by means of a frame structure, and the carrying mechanism is provided with a frameless space allowing an extension mechanism of the battery pack transfer device to enter when the battery pack transfer device places the battery pack in the carrying mechanism…” must be shown or the feature(s) canceled from the claim(s). No new matter should be entered. It is unclear whether or not the battery pack transfer device(not shown anywhere in the drawings) and the carrying mechanism(1) are referring to the same thing. Although the specification page 9, last paragraph states that “Specifically, the extension mechanism of the battery pack transfer device is usually a plug plate arranged on the lower surface of the battery pack 30 …”, however nowhere in the specification or in the drawings that “a battery pack transfer device” and “an extension mechanism” are labeled or shown.
Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance.
Claim Objections
Claim 4 is further objected as being in an improper format. In claim 4, delete the period(.) after the word “guide fork”.
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 and its dependent claims thereof recite the limitations of, “a charging compartment, configured such that a battery pack is placed by a battery pack transfer device, wherein the charging compartment comprises: a carrying mechanism, the carrying mechanism carries the battery pack by means of a frame structure, and the carrying mechanism is provided with a frameless space allowing an extension mechanism of the battery pack transfer device to enter when the battery pack transfer device places the battery pack in the carrying mechanism…”. It is unclear as to whether or not the battery pack transfer device and the carrying mechanism are referring to the same thing and it is also unclear what element(s) is(are) applicants referring to for the limitations of, “extension mechanism”. Although the specification page 9, last paragraph states that “Specifically, the extension mechanism of the battery pack transfer device is usually a plug plate arranged on the lower surface of the battery pack 30…”, however nowhere in the specification or in the drawings that “battery pack transfer device” is labeled.
Appropriate correction is required.
Claims 2-20 depend either directly or indirectly from claim 1 and therefore they inherit the same deficiencies and are also rejected for the same reasons.
Allowable Subject Matter
Claims 1-20 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action and subjected to showing a support for the underlined limitations mentioned supra.
The prior art of record does not teach neither reasonably suggest, among other patentable features, “…wherein the charging compartment comprises: a carrying mechanism, the carrying mechanism carries the battery pack by means of a frame structure, and the carrying mechanism is provided with a frameless space allowing an extension mechanism of the battery pack transfer device(subjected to showing support for the underlined limitations mentioned previously) to enter when the battery pack transfer device places the battery pack in the carrying mechanism; and an electric connection mechanism, the electric connection mechanism is arranged at the carrying mechanism, and the electric connection mechanism is configured to be electrically connected to the battery pack after the battery pack is placed in the carrying mechanism”.
