The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 103
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 39-64 are rejected under 35 U.S.C. 103 as being unpatentable over Ge et al (U.S.PGPUB 2021/0345237) and further in view of Xing et al (U.S.2022/0103990).
2. As per claim 39,45,50 Ge disclosed a method performed by a vehicle to everything, V2X, application specific server for supporting session-oriented services for a vehicle, the method comprising:
transmitting a session-oriented service trigger request to a V2X application enabler, VAE, server to initiate a session-oriented service for a VAE client of a V2X user equipment [Application function (AF) entity: The AF entity is configured to influence data routing, access a network exposure function network element, interact with a policy framework to perform policy control, or the like. For example, the AF entity may be a V2X application server, including a V2X application enabler (VAE) server, or may be a drone server (which may include a drone supervision server or a drone application service server] (Paragraph. 0101);
receiving a session-oriented service trigger response from the VAE server indicating whether or not the VAE server has an ability to initiate a session-oriented service with the VAE client [The V2X application enabler server supports at least the following functions: communicating with a 3GPP network element to obtain a unicast or broadcast communication resource and perform QoS adaptation; receiving, from the 3GPP network element, a monitoring report and an event that are about a network status; providing a monitoring event to the V2X application server; performing location management on multimedia broadcast/multicast service (MBMS)-based V2X communication; configuring a Prose layer-2 group identifier of group communication for V2X UE; provisioning a configuration parameter of a V2X USD; configuring and provisioning a PC5 interface parameter] (Paragraph. 0109);
transmitting a session-oriented service change trigger request to the VAE server, the session-oriented service change trigger request comprising an identity of a session of the session-oriented service and an update of QoS requirements of the session [Based on the foregoing technical solution, the network device may send the communication quality reference information of the Uu interface to the first terminal device after receiving, from the first terminal device, a request message for requesting the communication quality of the Uu interface, such that signaling overheads are reduced] (Paragraph. 0038), and
receiving a session-oriented service change trigger response from the VAE server indicating whether or not the VAE server is able to continue the session-oriented service with the updated QoS requirements [That the first terminal device updates the service requirement of the target data may be, for example, that the first terminal device triggers a PDU session change or QoS flow update, and the first network device modifies a parameter of a corresponding PDU session or QoS flow based on the trigger. For another example, that the first terminal device updates the service requirement of the target data may alternatively be that the first terminal device first notifies an application server that a PDU session needs to be changed or a QoS flow needs to be updated, then, the application server notifies the first network device that the first terminal device needs to change the PDU session or update the QoS flow, and the first network device modifies a parameter of the corresponding PDU session or QoS flow based on the notification]. (Paragraph. 0318).
However, Ge did not explicitly disclose, “receiving a session-oriented service establish notification from the VAE server indicating a session-oriented service has been established”.
In the same field of endeavor Xing disclosed, “The first network element is the session management network element or the policy control network element, and the communication method provided in this application may further include: The first network element obtains the service identifier of the first service and the address information of the first server from the first server through the unified data management network element or the unified data repository network element” (Paragraph. 0030).
It would have been obvious to one having ordinary skill in the art before the effective filing date was made to have incorporated the first network element is the session management network element or the policy control network element, and the communication method provided in this application may further include: The first network element obtains the service identifier of the first service and the address information of the first server from the first server through the unified data management network element or the unified data repository network element” as taught by Xing in the method and system of Ge to enhance the efficiency of the session communication services.
3. As per claims 40,46 Ge-Xing disclosed wherein transmitting the session-oriented service trigger request comprises transmitting the session-oriented service trigger request with information associated with the session-oriented service (Ge, Paragraph. 0219).
4. As per claims 41,47 Ge-Xing disclosed wherein the information comprises one or more of an identity of the VAE client, the identity of the V2X application specific server, an identity of the session, and a type or quality of service, QoS, requirement of the session-oriented service (Ge, Paragraph. 0101).
5. As per claims 42,48 Ge-Xing disclosed wherein the session-oriented service change trigger request comprises a change in server information; and wherein the session-oriented service change trigger response from the VAE server indicates whether or not the VAE server is able to continue the session-oriented service with the changed server information (Ge, Paragraph. 0237).
6. As per claims 43 Ge-Xing disclosed further comprising: receiving a session-oriented service change notification from the VAE server (Xing, Paragraph. 0030). The claim 43 has the same motivation as to claim 39.
7. As per claims 44,49 Ge-Xing disclosed further comprising: transmitting a session-oriented service termination trigger request to terminate the session-oriented service to the VAE server (Ge, Paragraph. 0237); receiving a session-oriented service termination trigger response from the VAE server; and receiving a session-oriented service termination notification from the VAE server (Ge, Paragraph. 0311).
8. As per claims 51,58,64 Ge-Xing disclosed a method performed by a VAE server communicatively connected to a network for supporting session-oriented services for a vehicle, the method comprising:
receiving a session-oriented service trigger request from a V2X application specific server to initiate a session-oriented service for a VAE client of a V2X user equipment [1. User equipment (UE): The UE may be referred to as a terminal device, a terminal, an access terminal, a subscriber unit, a subscriber station, a mobile station, a mobile console, a remote station, a remote terminal, a mobile device, a user terminal, a wireless communications device, a user agent, or a user apparatus. Alternatively, the UE may be a cellular phone, a cordless phone, a session initiation protocol (SIP) phone, a wireless local loop (WLL) station, a personal digital assistant (PDA), a handheld device having a wireless communication function, a computing device, another processing device connected to a wireless modem, a vehicle-mounted device, a wearable device, a terminal device in the future 5G network, a terminal device in a future evolved public land mobile network (PLMN), or the like, may be an end device, a logical entity, an intelligent device, a terminal device such as a mobile phone or an intelligent terminal, a communications device such as a server, a gateway, a base station, or a controller, or an internet of things (IoT) device such as a sensor, an electricity meter, or a water meter, or may be an unmanned aerial vehicle (UAV) having a communication function. This is not limited in the embodiments of this application] (Paragraph. 0075);
transmitting a session-oriented service trigger response to the V2X application specific server indicating whether or not the VAE server has the ability to initiate a session-oriented service with the VAE client [the first terminal device or a VAE client on the first terminal device detects communication quality of the PC5 interface. In one aspect, the VAE client may obtain communication quality information of the PC5 interface using a bottom-layer communication module of the first terminal device, and obtain the communication quality of the PC5 interface based on the communication quality information of the PC5 interface] (Paragraph. 0229);
receiving a session-oriented service change trigger request from the V2X application specific server, the session-oriented service change trigger request comprising an identity of a session of the session-oriented service and an update of QoS requirements of the session [In the embodiments of this application, a “service” may be used to describe an application, a service, a session, or the like, for example, a V2X application layer session or an intelligent transportation system application. A “service requirement” may include an application requirement corresponding to the service, for example, a volume of to-be-transmitted data, a time window corresponding to the to-be-transmitted data, a time limit on interaction between devices during transmission of the to-be-transmitted data, and a level of automation (LoA) of a V2X service. The “service requirement” may further include a communication requirement corresponding to the service, for example, a communication QoS requirement, including but not limited to a resource type, a priority, a transmission delay, a packet loss rate, a throughput, and the like. This is not limited in the embodiments of this application. Generally, there is a correspondence between application requirements and communication requirements. The LoA and QoS are used as an example. A correspondence between LoAs and QoS may be understood as that each level of automation corresponds to a group of communication QoS requirements] (Paragraph. 0125);
and
transmitting a session-oriented service change trigger response to the V2X application specific server indicating whether or not the VAE server is able to continue the session-oriented service with the updated QoS requirements [that the first terminal device triggers a PDU session change or QoS flow update, and the first network device modifies a parameter of a corresponding PDU session or QoS flow based on the trigger. For another example, that the first terminal device updates the service requirement of the target data may alternatively be that the first terminal device first notifies an application server that a PDU session needs to be changed or a QoS flow needs to be updated, then, the application server notifies the first network device that the first terminal device needs to change the PDU session or update the QoS flow, and the first network device modifies a parameter of the corresponding PDU session or QoS flow based on the notification. For how the first terminal device updates the service requirement of the target data, the foregoing is merely an example for description. This is not limited in the embodiments of this application. Any manner in which the first terminal device can update the service requirement of the target data falls within the protection scope of this application] (Paragraph. 0318).
However, Ge did not explicitly disclose “transmitting a session-oriented service establish notification to the V2X application specific server indicating a session-oriented service has been established”.
In the same field of endeavor Xing disclosed, “The first network element is the session management network element or the policy control network element, and the communication method provided in this application may further include: The first network element obtains the service identifier of the first service and the address information of the first server from the first server through the unified data management network element or the unified data repository network element” (Paragraph. 0030).
It would have been obvious to one having ordinary skill in the art before the effective filing date was made to have incorporated the first network element is the session management network element or the policy control network element, and the communication method provided in this application may further include: The first network element obtains the service identifier of the first service and the address information of the first server from the first server through the unified data management network element or the unified data repository network element” as taught by Xing in the method and system of Ge to enhance the efficiency of the session communication services.
10. As per claims 52,59 Ge-Xing disclosed wherein receiving the session-oriented service trigger request comprises receiving the session-oriented service trigger request with information associated with the session-oriented service (Ge, Paragraph. 0200), and wherein the information comprises one or more of an identity of the VAE client, the identity of the V2X application specific server, an identity of the session, and a type or quality of service, QoS, requirement of the session-oriented service (Ge, Paragraph. 0108).
11. As per claims 53,60 Ge-Xing disclosed further comprising: transmitting a session-oriented service request to the VAE client to establish the session- oriented service, the session-oriented service request including an identity of the VAE client, the identity of the session, and a reporting configuration; receiving a session-oriented service response from the VAE client indicating acceptance of the session oriented service request to establish the session-oriented service; and responsive to receiving the session-oriented service response indicating acceptance, transmitting a session-oriented service establish notification to the V2X application specific server (Ge, Paragraph. 0101).
12. As per claims 54,61 Ge-Xing disclosed further comprising: responsive to determining that the session-oriented service can be provided with the updated QoS requirements, transmitting the session-oriented service change trigger response to the V2X application specific server indicating an ability to continue the session-oriented service with the updated QoS requirements; and responsive to determining that the session-oriented service cannot be provided with the updated session parameters, transmitting a session-oriented service change trigger response to the V2X application specific server indicating the VAE server is unable to continue the session- oriented service with the updated QoS requirements (Ge, Paragraph. 0125).
13. As per claims 55,62 Ge-Xing disclosed further comprising: transmitting a session-oriented change request to the VAE client comprising update requirements or a change of server information; and receiving a session-oriented change response from the VAE client indicating acceptance of the change request; and transmitting a session-oriented service change notification to the V2X application specific server (Ge, Paragraph. 0318).
14. As per claims 56,63 Ge-Xing disclosed further comprising: receiving a session-oriented service termination trigger request from the V2X application specific server to terminate the session-oriented service from the V2X application specific server; and transmitting a session-oriented service termination trigger response to the V2X application specific server (Ge, Paragraph. 0093).
15. As per claim 57 Ge-Xing disclosed further comprising: transmitting a session-oriented service termination request to the VAE client; and receiving a session-oriented service termination response from the VAE client indicating acceptance of the session termination request; and transmitting a session-oriented service termination notification to the V2X application specific server (Ge, Paragraph. 0101).

16. Applicant’s arguments with respect to claim(s) 39-64 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
