Office Action

§112
DETAILED ACTION The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claims 1-20 as filed on 01/05/2023 are pending. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b ) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the appl icant regards as his invention. Claim 2 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 2 recites “the interlayer further comprises : the at least one organometallic compound”. Claim 1, upon which claim 2 depends, already recites “at least one organometallic compound represented by Formula 1” as part of the recited device structure. The use of the phrase “further comprises” in the context of reciting the organometallic compound is unclear with respect to whether the compound is the same as required by the parent claim or is additional. Clarification and/or correction are required. Allowable Subject Matter Claims 1 and 3-20 are allowed. The closest prior art is considered to be Li et al. (US 2018/0053904), which teaches platinum and palladium complexes with ligands having polyaryl rings (see abstract) for use in light emitting devices. The reference fails to teach or to render obvious the very specific ligand structure shown in instant Formula 1 including the six-membered nitrogen ring and CY1 to CY5 groups as recited in the instant claims.
