Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 1-20 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA), first paragraph, as failing to comply with the written description requirement. The claims contain subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventors, at the time the application was filed, had possession of the claimed invention. Claim 14 is directed to compound of formula 1, and claim 1 is directed to a light-emitting device comprising said compound. It is disclosed on page 107 that the claimed compounds provide a high efficiency and a long lifespan. Comparisons are made for the following inventive and comparative compounds, respectively, . These two compounds differ only by the presence or absence of the alkyl substituents on the pyrenyl groups. However, in the claimed compound, the subscripts c1 and c2 can be zero. In other words, the pyrenyl groups may be unsubstituted. Accordingly, the comparative compound 1 is an actual species of the claimed compound and, yet, it produces undesirable results. One of ordinary skill in the art therefore would not know how to pick and choose only those compounds that are commensurate with the scope of the claims and provide a high efficiency and a long lifespan. Allowable Subject Matter Aside from the aforementioned deficiency, the pending claims are allowable over the prior art as the compound of claim 14 is not disclosed or suggested anywhere. It is noted, however, that similar compounds having only one group of formula 1-1 are disclosed by CN 111662259 A (compound 459), WO 2020/073480 A1 (compound 29), WO 2020/073479 A1 (compound 40), CN 109180585 A (compound 049), CN 109180582 A ( compound 049), and US 2016/0111652 A1 (compound 17). There is not an obvious reason for one of ordinary skill in the art to modify the prior art compounds to arrive at the compound of claim 14 and the device of claim 1.
