Office Action

§102
DETAILED ACTION The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 11 -20 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Shimada et al. (US 5,098,807 A). Shimada et al. discloses the following compound for use in an electrophotographic photoconductor: (Table 1) such that a11-12 = 2, L 11-12 = -CH 2 -, b3-4 = 0, a1-3 = 0, and Ar 1-2 = C 6 carbocyclic group of Applicant’s Formula 1; corresponds to 1 as recited in Claim 20. Allowable Subject Matter 5. Claims 1-10 are allowed. The closest prior art is provided by Yang et al. (US 2016/0163989 A1), which discloses an organic electroluminescent (EL) device (light-emitting device) comprising the following layers: anode (110), hole-injecting layer (121), hole-transporting layer (122), light-emitting layer (123), electron-transporting layer (124), electron-injecting layer (125), and cathode (130) (Fig. 1); any one of the organic layers comprises compounds of the following form: where n1-2 = 0 or 1 ([0024]). An embodiment is disclosed: (page 5). However, it is the position of the Office that neither Yang et al. singly nor in further combination with any other prior art discloses the amine-containing compound of Applicant’s Formula 1 contained in a light-emitting device, particularly in regards to the nature of the R 2 group.
