Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statements (IDS) submitted on 2/27/24;3/13/23;2/24/23 are in compliance with the provisions of 37 CFR 1.97(b). Accordingly, the IDSs are being considered by the Examiner. Allowable Subject Matter Claim 3 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 4,12 are further rejected based on dependence on claim 3. Claim 6 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 7,8 are further rejected based on dependence on claim 6. Claim 9 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claim 10 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claim 14 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claim 16 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 17-18 are further rejected based on dependence on claim 16. Claim 19 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claims 1-2, 5,11,13,15,20-22 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by R&R Ventures KK (JP 2000 237329) (“R&R”). R&R discloses: A medicine administration tool capable of use in a transocular iontophoresis device for forming an electric circuit between a first electrode and a second electrode and supplying medicine to an eyeball (figs. 11,12; x) [0100-0118] the medicine administration tool (x) comprising: a tubular member having a first lower end configured to face the eyeball (figs. 11,12; a); an inner member having a second lower end configured to face the eyeball (figs. 11,12; b), the inner member being accommodated in a space of the tubular member and forming a medicine accommodating chamber for accommodating the medicine between the inner member and the tubular member (figs. 11,12; 14); and a support member (screw portion; bushing—claim 21) movably supporting the inner member with respect to the tubular member (figs. 11,12; [0104]). the support member is configured to move the inner member with respect to the tubular member in an axial direction of the tubular member. [0109] a first protective material is located at a first lower end; and a second protective member is located at the second lower end, the second protective material being accommodated in the space of the tubular member (13,15) the second protective material (15) is a film-shaped body capable of covering an entirety of a cornea with respect to claim 15, the inner member b is a closed body with respect to claim 20, an exhaust hole is formed in the tubular member to discharge gas to outside of the tubular member [0114,0137] with respect to claims 21-22, see above.
