Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This office action is responsive to the Request for Continued Examination, Amendment and Remarks filed 2 June 2026, wherein claim 4 was canceled and claims 17-20 newly added. Subsequently, claims 1-3 and 5-20 are pending and presently under consideration in this application. Response to Amendment Applicants have amended independent claim 2 to recite “; and R1 and R2 are not bonded to or bonded to each other to form a hetero ring”, thus introducing new considerations as follows. Claim Rejections - 35 USC § 112(a) The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 2, 3 and 5-16 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Claim 2 has been amended to recite “R1 and R2 are not bonded to or bonded to each other to form a hetero ring” (emphasis added). While the specification as originally filed supports “wherein R1 and R2 are bonded to each other to form a hetero ring” ([0019], [0141], original now canceled claim 4), and “wherein R1 and R2 are bonded to each other to form a pyrrolidine skeleton, a piperidine skeleton, or a hexahydropyrimidopyrimidine group” ([0023], [0141], original claim 5), there appears to be a lack of support in the specification as originally filed for “R1 and R2 are not bonded to or bonded to each other to form a hetero ring” (emphasis added). Claim Rejections - 35 USC § 112(b) The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 2, 3 and 5-16 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Amended claim 2 is rejected as being vague and indefinite when it recites “; and R1 and R2 are not bonded to or bonded to each other to form a hetero ring” (emphasis added); the scope of the protection sought by “are not bonded to” without anything identified is not clear. Amended claim 2 fails to particularly point out and distinctly claim the substituents R1 and R2 of the third organic compound BM represented by formula (G0) contained in the claimed light-emitting device. Allowable Subject Matter Claims 1 and 17-20 are allowed. Claim 2 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Claims 3 and 5-16 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
