DETAILED ACTION The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 13 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The claim, which is dependent on Claim 1, recites that the organometallic compound of Formula 1 ”comprises at least one selected from among the compounds in Compound Group 1” which renders the exact scope of the claims indefinite as it is not clear how a plurality of separate organometallic compounds of Compound Group 1 can correspond to a compound represented by Formula 1 (which represent s a single organometallic compound). The Office has interpreted the claim to instead recite that “the organometallic compound represented by Formula 1 comprises at least one is any one selected from among compounds in Compound Group 1” for the purpose of this Examination. Correction is required. Allowable Subject Matter 5. Claims 1-12 and 14-20 are allowed. The closest prior art is provided by Tsai et al. (KR 10-2020-0143654), which discloses compounds of the following form: ([0009]); embodiments are disclosed such as the following: (page 100). However, it is the position of the Office that neither Tsai et al. singly nor in further combination with any other prior art discloses any of the compounds of Applicant’s Formula 1, particularly in regards to the nature of the tetradentate ligand connected to M 11 .
